However, I live in the State of Philadelphia, ( I mean City of Philadelphia) and the Philly PD is always looking for the slightest excuse to take a gun and tell you to tell it to a judge to get it back. ^^^ This is what a lot of folks have expressed....that being, guns that were Dad's have sentimental value and everyday carry seems inappropriate, thus, other guns are acquired for carry purposes.

Alright legal beagles, I have one for yinz. Man has wife, kids and gun collection. He gets divorced, marries new wife who has no kids and kicks the bucket leaving all personal possessions to second wife. Is she allowed to give guns to the man's adult offspring (AKA her stepchildren) without FFL transfer (all within PA)?

They are not her children (unless she had adopted them). Do the math.

From how I understand it, unless step-mom adopted the kids of her husband, she cannot give those firearms to his kids, unless it was stated in his will. IANAL.

You left out the part where the first wife gets half of his gun collection.

I assume we're talking about handguns; long guns are easy within the state, handguns are PA "firearms". She can't do it as their mother, but she COULD do it if she disclaimed that part of his estate and the kids were next in line through the rules of intestacy. They would be directly inheriting from their dad, and inheritances are an exception to the FFL requirement for handgun transfers.
She'd probably need a lawyer to do it right.
