Legal residency for firearms and legal purposes.
Have a friend that lives in Lehigh County but uses an address of another person for all legal purposes in Northampton County. Has never spent even one night there although registration, DL and even firearms purchases use that address. Gets cheaper car insurance in Northampton too.
Legal or not? What is the penalty and what is the description of legal residency?
Re: Legal residency for firearms and legal purposes.
I have no idea of the actual, correct answer, but it seems there could be multiple counts of "unsworn falsification (§4904)" for every form and/or application that was knowingly filled out with untrue information.
Re: Legal residency for firearms and legal purposes.
Can't say what the legalities are, but knowingly falsifying his residence, particularly with the purchase of firearms, and perhaps a LTCF, I would imagine is legal jeopardy to say the least. Willing to bet an insurance company would fail to cover anything under such conditions, if they were to come to light, and end up in jail if it came to light afterwards.
This person is a schmuck.

It is a federal crime to use a false address for a firearms purchase. IANAL, but that may make you a prohibited person.
And a felony in PA. :
Under 18 Pa.C.S. Sec. 6111(g)(4):
Any person, purchaser or transferee commits a felony of the third degree if, in connection with the purchase, delivery or transfer of a firearm under this chapter, he knowingly and intentionally:
(i) makes any materially false oral statement;
(ii) makes any materially false written statement, including a statement on any form promulgated by Federal or State agencies; or
(iii) willfully furnishes or exhibits any false identification intended or likely to deceive the seller, licensed dealer or licensed manufacturer.
That would definitely make you a prohibited person.

I know that if/when the insurance company finds out, they will try to charge him unpaid back premium differences. As far as firearms, I'd agree he is lying on Form 4473 and dancing precariously with ATF.

I hope so too. Problem is the address he uses allows him to get all mail there, drivers license there etc although he has never spent one night there.

If the auto insurance finds out, it's felony fraud = loss of 2A
