Is it illegal to private sell or transfer long guns in pa?
I know i've heard it a million times otherwise, but i am trying to figure out what makes this wrong:
PA Title 18 section 6111:
Code:
(c) Duty of other persons.--Any person who is not a licensed
importer, manufacturer or dealer and who desires to sell or
transfer a firearm to another unlicensed person shall do so only
upon the place of business of a licensed importer, manufacturer,
dealer or county sheriff's office, the latter of whom shall
follow the procedure set forth in this section as if he were the
seller of the firearm. The provisions of this section shall not
apply to transfers between spouses or to transfers between a
parent and child or to transfers between grandparent and
grandchild.

I think this has to do specifically with the definition of "firearm" in the referenced section of text. I believe there are multiple definitions of "firearm" used in PA code and some are narrowly defined to basically only refer to handguns, and others are much broader. You have to know which definition applies to that section. I am not a lawyer and not an expert on law.

This is the definition. Cleared it up a bit

Pa tp Pa res with driver license ok. Long guns, shotguns, c&r ok. Shotguns and rifles need to be correct barrel length.

PA residents that do not have a driver's license can legally transact as well, so long as they are not legally disqualified by means of criminal record or involuntary mental health commitment.

I wouldn't do it unless the buyer had a note from their parent, or guardian.
Damn the LTCF.
