Seems like it would be easier to have the boyfriend transfer the handgun to either you or your mother, (your brother is away, bla, bla), preferably your mother. The person who receives the firearm, after passing a background check is the owner, period. Since that person has no intention of ever selling or giving the handgun, that person will be "The Actual Transferee/Buyer" (question 11a on 4473, question 33 on SP 4-113). If your mother, at some time decides to give it to her son, no transfer will be required. If you are Transferee, you could decide to give it to your mother, no xfer, and then , at a later date, she could give it to your brother. As fickle as the human mind is, the change of mind could be only a minute or so.

Her is the Pa. crimes code. Pay extra attention to chapter 61. There are other areas pertaining to guns and their possession. You seem to have a lack of the basics. This is not a condemnation I just do not want to see people hemmed up because they do not know the actual law. When it comes to guns you will be treated like a demon from hell itself for an honest mistake.
Do not ask for advise from a gun store or the police. Do not believe what uncle Lou told you. Read the law for yourself and find the supporting info to see what it means in the eyes of the courts at this time.
You have received good advise so far in this thread. My suggestion would be to be careful what you posts next as you have already made some cardinal mistakes.
Good luck with your situation as it seems to be a potential powder keg.

Skirting the law is never a good thing when dealing with guns. I disagree with the laws but they are the laws at this time.

If he carries it and is stopped , and the pistol is run against the PA-RoS database and comes back 'recorded' in someone elses name (or worse, stolen!), he'll have some explaining to do. And that story just might get him and Mom's boyfriend in a big pile of doo-doo.
