If it is a lower that has never had an upper on it, it can go either way. Its all about the length of the barrel. If you sell it as a pistol it must be transferred as such.
No matter what you tell yourself, size matters :D

When you go to pick up your lower from your ffl, inform them that you want to make it into a pistol, so they can give you the correct paperwork to fill out. They run through the same process as buying a glock or 1911.
I just did it two weeks ago. It's easy.
Define "virgin".
Are you talking about an 80% lower, or a "100%" stripped lower?
What makes it a "virgin"?
And what if an FFL was never involved?
What if a stripped lower is purchased FTF without any FFL/paper involvement? Could that be made into a pistol?
I would assume it would have to be considered a rifle since no FFL was used, but I really don't fully understand the whole "pistol/rifle/other" stuff.
Virgin refers to never been assembled. Most dealers just call them stripped.
Pistol= If you buy an AR lower that is stamped pistol or barreled less than 16" it is transferred as such.
Rifle= If it has a barrel more than 16".
Other= Is a virgin or stripped lower that has not been classified or had an upper attached.
It can be from a 100%, an 80%, or a 0%. ;)
I didn't know 'other' was an option. I'm a boot in this respect.
