EC police: Homeowner shoots alleged home invader
Police are investigating the shooting of a New Bern man they say was shot during a home invasion in Elizabeth City early Friday morning.
Tyrell L. Johnson, 38, was shot twice by a homeowner after entering a house in the 400 block of Bell Street at 6:37 a.m., Agent Lamont Butts, a spokesman for the Elizabeth City Police Department, said in a press release.
According to Butts, Johnson entered the house by a back door and was confronted and then shot by the homeowner. Butts declined to name the homeowner but said the resident is the one who called police about the incident.
Johnson had left the Bell Street residence by the time police arrived, Butts said. Police were alerted that he had driven himself to Sentara Albemarle Medical Center, where he sought treatment, Butts said.
Dale Gauding, a spokesman for the hospital, said Friday that Johnson was transferred to Sentara Norfolk General Hospital, where he is in fair condition.
Butts declined to say if Johnson is in police custody, saying only that Johnson “is no threat to the public.” He did say charges of home invasion are pending against Johnson.
According to Butts, Johnson’s last known address is the 200 block of Keener Avenue, New Bern. There is no indication Johnson had any previous contact with the homeowner who shot him, Butts said.
Police are still investigating the shooting and asking anyone with information about Johnson or the incident to call either 335-4321 or Crime Line at 335-5555.

No charges filed in Leaf Valley shooting death
Al Edenloff
After reviewing the investigative materials in the case, Douglas County Attorney Chad Larson determined that Bragg's girlfriend was acting in self-defense when she shot Bragg, 43.
In a Jan. 25 letter to Douglas County Sheriff Troy Wolbersen, Larson said the facts showed that Bragg discharged his firearm at his girlfriend from close range while the two were engaged in an altercation that had become physical.
Bragg reportedly moved to the area in the fall of 2017 and was living in a house with his girlfriend and her two children at 7395 County Road 5 NW, Garfield, about one mile west of The Leaf Valley Mercantile.
At about 4:10 p.m. on May 9, the sheriff's office received a 9-1-1 call about a domestic disturbance in progress at the house. As law enforcement officers were responding, they were advised by a dispatcher that a firearm was involved and shots had been fired.
Upon arrival, deputies talked to Bragg's girlfriend and the two children who were at the residence during the disturbance, according to the sheriff's office. They were all uninjured.
Deputies found Bragg's body in a living room area downstairs.
The girlfriend told investigators that Bragg had assaulted her and ultimately fired a gun at her. She stated that she immediately shot Bragg after he fired a handgun at her, according to Larson.
The Bureau of Criminal Apprehension processed the scene and studied the trajectory of a bullet hole in a location consistent with Bragg discharging his firearm at his girlfriend as she was going up the stairs.
Fingerprint and DNA evidence collected at the scene and statements from witnesses were consistent with the girlfriend's version of events, Larson said. Alcohol and drugs didn't appear to have played a role in the incident, he added.

Man found not gulity of murder, defense says it was self-defense
Posted By: Vanessa Alonso
(St. Joseph, Mo.) A St. Joseph man is found not guilty of murder.
Raydel Cespedes, 26, was charged with second degree murder and armed criminal action in the shooting death of Anthony Miner Jr., 27. The shooting happened off the 2000 block of Edmond Street back in August 2017.
Proscutors alleged Cespedes shot and killed Miner during an argument at Cespedes' home. The defense argued that Cespedes acted in "self-defense."
Cespedes who did testify in court says Miner got very angry and Cespedes was afraid for his life and reached for a gun. He fired one warning shot but didn't think a second shot would hit Miner.
It took a 12-person jury only three hours to come up with the verdict.
Cespedes and his family broke down in tears when the verdict was announced.

OC Prosecutors Decline Charges Against Three In Fatal Shooting
Contributing EditorFebruary 1, 2019

Three men arrested this week in connection with a fatal shooting in Anaheim in September were released from jail without being charged, as prosecutors deemed that the killing was in apparent self-defense.
Larry Robert Douglass II, 19, of Artesia, Johnathan Michael Rowe, 19, of Santa Ana, and Zachary Jay Goemaat, 19, of Santa Ana, were booked on Wednesday on suspicion of the Sept. 29 fatal shooting of 36-year-old Julio Cesar Munoz of Placentia, Anaheim Police Sgt. Jeff Mundy said.
Munoz got into a conflict with the three men before he was shot. Prosecutors felt the three acted in self-defense, Mundy said.
Police were called the morning of Sept. 29 to a cul-de-sac in the 1200 block of North Sunshine Way when the man’s body was found near a trash bin enclosure, Mundy said. Investigators concluded Munoz was shot just after midnight during a “factory party,” which features gatherings in industrial areas, Mundy said.
Police said they spent the past four months interviewing dozens of witnesses, reviewing video footage and executing about 20 search warrants before linking the three men to the fatal shooting, Mundy said.
Douglass, though he was not charged with the killing, was charged with a count of being a convicted felon in possession of a gun.

VIDALIA — Concordia Parish Sheriff’s Office deputies are investigating a Thursday night shooting that injured a man who officials said was attempting to break into a residence in Vidalia.
“They had a guy break into a trailer, and the guy defended his property,” said David Hedrick, Concordia Parish Sheriff’s Office chief deputy.
Hedrick said multiple suspects attempted to break into a residence on Ralphs Road and the resident defended himself by shooting.
Hedrick said the homeowner would not face charges in the shooting since it was self-defense.
“There were multiple subjects that attempted to break into a home,” Hedrick said. “One was shot and the others fled.”
The one suspect was hit, Hedrick said, and the other suspects fled.
