Castle Doctrine HB 40 in 09 does anyone REALLY want this passed?
If so please read on WE need your help. Here is our political problem last session despite numerous broken promises from key people in leadership we could not get our castle doctrine bill up for one single vote in the judiciary committee. While several pieces of anti-gun legislation got THREE chances for a vote, thankfully all those anti-gun votes failed due in large part to PAFOA active involvement of contacting our Reps (gun owners can make a difference). WE have a plan to get this out of judiciary committee despite anti-gun political tricks, one way or the other, but it can not be done without your help. IF you want this bill, its time to step up and do your part to get this passed into law. After Rep Rohrer’s 10 amendment rally on 3-16-09 several PAFOA people helped hand deliver Kim Stolfer the following letter to approximate 92 Reps that usually vote pro gun or new Reps. We actually got to talk with a few Reps and picked up more co sponsors. Quote:

Use the above letter for a guide or write your own. Follow this letter up with a phone call to both the Harrisburg and local office. Leave your name and phone number for your Rep to call you back and ask to talk with your Rep about being a co sponsor. Why a snail mail letter? Email is quicker of course. A written letter creates a pile of paper work that goes on their desk, a few email can be easily be ignore as we all have been know to do. A written letter by a constituent GETS READ, you also could fax the letter it also creates a physical presents that just an electronic email file doesn’t. You could also snail mail / fax a letter to both Harrisburg and local district office. You also could make an appointment to meet with your Rep in their local office to speak to them about HB 40 co sponsorship, do any of the above. All contact information is for the Reps Harrisburg office see web site for local district contact information Here is a list of about 13 remaining Reps that usually vote pro gun (4 “A” rated) Three PG that was sponsors last time and are not currently co sponsors now. PLEASE FOCUS on remaining Reps on this list even IF they are not your Reps contact them and ask for support. Quote:
Rep Jerry Knowles won a special election in May 19 to fill a vacant seat in the 124 district. So you have every right to contact them and ask for their support for this bill, after all this isn’t just for one area but for everyone in PA. Couple points here The prime sponsor Rep Scott Perry is overseas fighting for our rights so the least we can do is our part to support this bill. Also since Rep Perry had to leave very early in this session most his memos including his letter requesting co sponsorship to HB 40 got lost in the paper work shuffle. The web site list only 56 co sponsors, it will not be updated unless there is a status change in this bill or action is taken for a new printer number. Rep Perry’s staff sends me an updated co sponsor list about once a week or so. I am going to inquire about a technical amendment / update to this bill after we have more sponsors. IF we can not get this bill pushed into action for an up or down vote in the judiciary committee we will get nothing except more broken promises like last session. That is unacceptable. There are several ways to force this out of the judiciary committee they all involve having an over whelming majority of co sponsors. There are 26 members of the house judiciary committee. There are 8 members that probably will not vote for this bill. 14 members usually vote pro-gun (13 are current co sponsors, two others were past co sponsors last session but are not currently) There are 2 unknowns vote. Option two: if we can get a majority of co sponsors around a hundred we can have the media start also asking why this bill is not getting an action or at least a up or down vote. This will cause lots of political grief to the road blocking people that didn’t let us have a vote last session and shine a very bright spotlight on them something they wish to avoid.
Option three (I believe this correct) is a seldom used political maneuver, to use this option we got to have the co sponsorship in the 110-130 range to do a petition discharge drive to bypass the judiciary committee and bring the bill to the house floor for a full vote. With the prime sponsor overseas this will make this more difficult, but not impossible, yet another reason for having more co sponsor. If WE can get this bill up for a straight up or down vote it will pass, the only problem will be to keep this a clean bill with us not allowing any poison bill killing amendments to be attached. Both house will pass this if we just to our part and let them know we want this bill enacted. Is this a perfect bill? Nope but it will fix a lot of problems with civil liability for the Citizens and police officers alike to defend ourselves from the criminals Also there will be introduced a senate version of this bill Kim Stolfer and Others are working on this right now and hopefully it will have the same identical wording as HB 40 to speed up the legislative process. Its introduction should be a part of the April 21 09 rally The governor will sign this bill if we can get it on his desk in 2009 or spring of 2010 latest because he still has to work with these Reps to get anything else he wants accomplished politically, also with your help this bill will pass with a veto proof majority. Here is the choice you all have to make, you can part of the problem by doing nothing, or you can be part of the solution by taking action. PAFOA people have a real opportunity presented here for them to actually improve their rights for everyone benefit and feel good about making a difference, because with this issue you can. All that you have to do is decide to take whatever action is required to support HB 40 WE can make PAFOA more than just an internet forum, WE can make PAFOA place that we are proud of because of what we can accomplish by working together towards a common cause. Mr. XXXXXXXXXXX Thanks for contacting me regarding HB40. You are correct, this bill has been referred to Judiciary and I do now serve on that Committee. I will be speaking with Chairman Caltagirone and request that he bring up the bill for consideration. You should also know that although I am not currently a co-sponsor of HB40 that I will plan on supporting it given the opportunity to both in Committee and if it is considered by the full House. Best regards, Joe Brennan This was my original email: Representative Brennan, Being as you are on the House Judiciary, it is of utmost importance that HB40, Right to Stand Your Ground (aka Castle Docrine) get a chance for vote in the judiciary. It has been noted that several pieces of anti 2nd amendment legislation were brought up for vote in Judiciary last year. Not one was brought up to secure the legal safety of responsible individuals to protect themselves. I have been in email contact with you on at least one occasion attempting to persuade your support for 2nd amendment rights. Further restricting these would only penalize and create a situation where law abiding citizens are LESS SAFE in their community. Two most important things to notes: 1) Increase gun control does not decrease crime. It only makes it more likely that violent crimes will occur more often. Please check DOJ stats. Florida is a state that when they enacted concealed carry laws, violent crime rates dropped. This decrease in violent crime rates was due to enabling law abiding citizens to exercise their second amendment rights as guaranteed under the Constitution. And these drops were seen in every state enacting legislation in favor of law abiding citizens. 2) Criminals do not by definition follow the law. So further restricting legislation on legal possession only enables criminals to continue on their path of violent crimes. Honestly, it’s a deterrent when criminals know their potential victims are able to protect themselves. I understand you are newly elected and really there is little track record to see your stance on 2nd amendment rights. But I can tell you that there are many of your constituents awaiting to see if we have made the right decision. Please help get HB40 up for at least a vote in Judiciary. And help continue the Commonwealths tradition of exercising their rights to bear arms. As Article 1, Section 21 of the Commonwealths Constitution states “The right of the citizens to bear arms in defense of themselves or the state shall not be questioned”. Thanks for the update. With the current co-sponsor list both my guys are now on-board. I have to make sure I stop by and see him on the 21st to thank him for his support. I'm already prepping my senator if this makes it into a senate bill. Supposedly, all these guys meet regularly to talk about these things.
It is also great to see we picked up six more sponsors from the last time. Keep up the good work, everyone!! |
