Dear Readers:

This week's update contains some interesting news.

TSA FOIA DECISION REVERSED

The Office of General Counsel at the Department of Homeland Security has finally responded to my appeal of the denial of access to air marshal training materials. In a letter dated April 12, 2007, DHS states that TSA improperly applied a "blanket justification" in withholding the records. However, no discussion was made of the points I raised concerning the propriety of TSA invoking the exceptions in the first place.

As a result of this decision, TSA must review the air marshal training materials again and and release portions of the documents. They still may withhold information they believe is covered by the exemptions cited for the original denial. Therefore, it is possible that documents eventually released will be of no value in learning about the air marshal program. I will let you know what response, if any, I receive from TSA. In the meantime, a copy of the letter will be posted in the "What's new" section of the Armed Passengers Project website.
