Is there anyone who is able and willing to scan and send me a copy of this article? There may be some material in the article that I could incorporate into my remarks to the Uwchlan Township Board of Supervisors meeting next Monday, 14 September.
I'll see what I can do to get you a copy. It appears that PSATS only has older issues online at this point. My apologies.

No worries!

Someone already scanned and sent the article to me. I'm not sure if he'd want me to mention his user name, but I sure do appreciate his quick response and help!

Thumbs down Re: Municipalities in violation of §6120 (Preemption)

Good evening.

After reading the P.S.A.T.S. article on preemption violations, I must say that I could not disagree more strongly with the so-called legal conclusion expressed in the closing paragraphs of the article.

The article concludes, "Because there is no specific controlling authority on this issue [firearms regulation at the township level], reasonable minds may differ..." It is mind-boggling how a lawyer, who was consulted for this opinion expressed in the article, could draw such a bizarre conclusion. I just don't know how much more clear 18 Pa. C.S. §6120 (a) could be.

Before reading the article, I had wondered about the politics of P.S.A.T.S. This question is no longer unclear to me.

Thumbs down on more junk so-called journalism.

That one is interesting. I carry openly and concealed all over Ebensburg including parks and police have seen my gun. No one has ever said anything.

This forum is full of useful info. Thanks.

These preemption violations are a dime-a-dozen. I just verified that Downingtown, Pennsylvania also has a firearms ban in borough parks. The ban is on page six of the attached PDF file. It is marked letter N.

Ugh. I love how little tyrants can't change the state law so they try to intimidate people into being afraid of carrying through these kinds of laws. I knew they had them elsewhere but I never thought Ebensburg would be on the list. I am sorely disappointed.

So go to the monthly meeting, and get them to reverse/recind the Illegal ordinance.......

If I do that and they refuse what recourse is there?

EDIT: I just read the thread below with the info on how to change it and I am going to find out when the next meeting is. I will see what happens.

Anyone else live in Ebensburg and want to come with me?

Not in your area, but I can travel 2-2 1/2 hrs for moral support....
