There's no point in getting an attorney to get back a gun. What kind of gun exactly is this, value will most likely outweight cost of legal services. Post what the actual reason for denial is and everyone in here can chip in a figure something out for you. Represent yourself; unless you want to get your gun back and make a statement to the Philly PD and cost doesn't matter.

I'd drag them to court to get them back, if for no other reason than to embarrass the policymakers. Policy does not override law, no one can legalize murder, robbery, thef or assault by declaring it "policy". If someone unlawfully retains your property, it's theft. We don't need a court to give us a blinding glimpse of the obvious. Another reason I'd go after them is it's a mark of innocence. If you quietly melt away, it might look like you tacitly admitting guilt (silence is acceptance, and all that). Consider filing a complaint with the PA State attorney general, as Phila and Harrisburg have along history, and Phila is well known for being a rogue antigun bastion that gets reined in once in a while. And as another poster pointed out, there's the publicity aspect. Just my thoughts. Rick |

Phil does not handle these cases types of cases in Philly, he was the guy I called when I saw this post. He's the one that recommended the guy I posted.

Phillydev,
Although I can't be of assistance, because I'm nowhere NEAR Philly, I DO want to wish you good luck in your fight to have YOUR PROPERTY returned. To me, this "policy" of the Phila. PD is just outright THEFT, and I hope that you can find a good lawyer who can not only get YOUR property returned to you, but maybe can help get that "policy" reversed. Hmmmm.although they are notoriously screaming liberals, wouldn't it be fun to sic the ACLU onto the Philly PD over this policy, since YOUR CIVIL RIGHTS are being trampled on? Just a thought.....

you might also want to contact Rule10b5 on GlockTalk.
i don't think he is from philly, but he is from that general area. he is a pro-gun lawyer who makes some very good posts on GT. he gets all fired up about things like this and might be willing to at least guide you through the process pro bono. i dunno, but contacting him can't hurt. (ETA: someone else--don't remember who or on what forum--contacted the ACLU about something similar once and posted the letter he got in response. the ACLU said they don't consider the RKBA an individual right. argh. i just about cancelled my membership right then and there...but, they are one of the few organizations that actually effectively go to bat for the other 9 amendments in the bill of rights, so i didn't. just like the NRA, they do a lot of things that really tick me off, but i still think we are better off with them than without them. ok...i'm putting on my flame suit now )
