PA House of Representatives Judiciary Committee Action Imminent

The PA House Judiciary Committee has scheduled a vote on two important pro-gun pieces of legislation up for a vote next week on January 24


House Bill 1668 is meant to address the weaknesses in Pennsylvania law regarding the transportation of firearms and the criteria for which has created many hardships for Pennsylvania gunowners.

This bill was introduced by Rep. Tim Krieger who is to be commended for his willingness to take on this thorny social issue and try to resolve some of the mistakes that continue to plague citizens across this Commonwealth!

FOAC will grade a vote in support of this legislation as pro-gun. We encourage all gunowners to take a long look at this and consider contacting their representatives!

House Bill 1523 was introduced by Rep. Daryl Metcalfe to address the issues that continue to result in violations of Pennsylvania’s preemption law that prohibits local communities from enacting their own gun laws. Since there appears to be an unwillingness by the district attorney's in the counties where these flagrant violations are occurring to hold accountable these local communities criminally as is provided for in the law, this legislation provides for the option to hold these communities and those who enact the laws civilly responsible by imposing financial penalties.

Representative Daryl Metcalfe is to be commended for doggedly pursuing these local communities flagrant violations of the law and attempting to institute an appropriate remedial action option.

FOAC will grade a vote in support of this legislation as pro-gun! We encourage all gunowners to take a long look at this legislation as well and consider contacting their representatives!

If you are all for the concept of doing away with the stupid requirment that you can't not stop anywhere unless you have a LTCF permit because you are transporting a unloaded firearm.

I always confuse my PA Rep with my US Rep. In this case I believe I would need to contact newly elected Rep Tina Davis?

Would you consider contacting the new prime sponsor Rep Krieger and adding your name to this important legislation to protect innocent people from running afoul of the law



As a review of what the Right to Transport firearm bill address



This proposed legislation corrects current law in regard to the transportation of unloaded firearms in Section 6106(b) of Title 18.



Currently you can only transport unloaded firearms to limited destinations without any stops for any reason, no exceptions. This legislation will remove inconsistencies in the law and also benefit travelers from other states who transport firearms through PA



As a example the problems this will correct.

Gun owners (who do not possess a License to Carry a Concealed Firearm) can ‘only’ transport lawfully owned and unloaded firearms (definition in Title 18-§6102) to four places (not counting hunting) with NO STOPS in travel.

To & from a gun club.

To & from a ‘licensed’ FFL dealer

To & from a recreational home

To & from the police to surrender or recover a firearm.

To & from hunting with license (seasonal).



The existing laws language does ‘not’ allow for ANY STOPS for ANY reason and that includes fueling vehicles, dining out, and even denying restroom stops.

Being found guilty of violating this law carries a ‘lifelong loss of the right to own a firearm’.

This criminal violation requires NO mens rea (guilty mind/criminal intent).



Here is the essences of the change in the law

Adds a simple section of the law to correct the problem - section (17) Any person who is not otherwise prohibited from possessing, using, controlling, selling, transferring or manufacturing a firearm shall be entitled to transport a firearm for any lawful purpose if, during such transportation, the firearm is not loaded

This will Protect Citizens against unintentional violations of the law and unwarranted and specious prosecutions





So Please consider adding your name as a co sponsor along with the many other Reps that have already signed on Rep Tim Krieger “Right To Transport Firearms” to remove this current injustice from lawful firearm transportation

If we could get this simple correction in the law passed look at all the warning comments that everyone wouldn't have to make to everyone that doesn't have a LTCF permit.

So IF you want this passed into law, consider doing your part by contacting the Reps and be part of the solution, instead of complaining about the problem.

If the eight replies follow through this should give us in the mid 60's for sponsors, IF we can get this past the 100 number good chance of getting this moved.

If we can just get ALL the past sponsors to sign on again this should put us in the mid 90's alone. so that 103 magic number is not that hard to reach
