Has been submitted in Arizona, let's do likewise here in Pennsylvania. I've already sent a copy to my state representative (Sam Smith - Punxsutawney):

A version of the bill was first introduced in Arizona (HB2456 in 2002) by Rep. Randy Graf (R-6th), with considerable support (12 sponsors!). In 2003, Rep. Graf re-introduced it in Arizona (HB 2320). The state of Georgia joined the effort to enact this important new legislation with HB31, introduced by Rep. Bobby Franklin (R-17th). At least two other states actively considered the bill. The Gun-Free-Zone Liability Act has excellent value even if it isn't enacted in its first years -- it is a just and common-sense bill that would help protect the public. Resisting its reasonable provisions requires taking the moral low ground -- that you have no right to defend yourself. A lot of very bad gun bills are planned, so it's critical to balance that with bills as positive as this one. Ask your legislators to at least look at the bill and support it. Basically, "If you create a gun-free zone, you're liable for any harm it causes."

It should be common sense/common law.
For equivalence: I believe in wearing helmets while riding but not in legislating it. On the other hand, if it can be determined that you would not have died had you had one on, then wrongful death should be more problematic. But let's say I allow people to ride motorized vehicles on my property, but I tell them I hate helmet laws, so if you want to ride on my property, you MUST remove your helmet. Well, one day someone gets a severe head trauma. I am free and clear of all responsibility (legally) right? I don't think so. I enticed someone to do something less safe and to take a risk to enjoy riding on my property. They are paying the price now. I will probably be paying the bills. How is it, self-defense is any different? Take away my right and ability, then you are assuming responsibility for my safety. Last edited by TaePo; December 15th, 2007 at 12:34 PM. It makes perfect sense. Thats why I'm thinking it could be an uphill battle to get something like that passed. It flies in the face of what this country has become over the years. A place where nobody is responsible for anything they do or cause, everybody is a victim.

I wonder if in the right court it might not work now? We sue now for all sorts of reasons. Why not for this.
And the fear of lawsuits drives most of the rules we see today. They don't put up the gun-free zone signs because the wall "needed something" to fill an empty space. They do it because they fear guns and the lawsuits that can come if someone miss uses a gun. The sign shows "we tried to protect". And putting on a show is a lot cheaper and easier then doing the job of protecting the public. Hence we get gun-free signs and gun-control laws. When I hear about another gun-free zone or a new gun-control law the only thing that comes to my mind is "Please pass the popcorn". |
