Public Hearing Notice
The Committee on Public Safety of the Council of the City of Philadelphia will hold a Public Hearing Wednesday, December 1, 2010, at 2:00 PM, in Room 400, City Hall, to hear testimony on the following item:
100722 .... An Ordinance amending Chapter 10-818 of The Philadelphia Code to provide that no person shall carry a firearm on public streets or public property unless the person is licensed to carry such firearm by a political subdivision of the Commonwealth of Pennsylvania, regardless of whether the person possesses a license issued in another state, under certain terms and conditions.
Immediately following the public hearing, a meeting of the Committee on Public Safety, open to the public, will be held to consider the action to be taken on the above listed item.
Copies of the foregoing item are available in the Office of the Chief Clerk of the Council, Room 402, City Hall.

The only time and money spent will be by legal gun owners trying to fight this in court. Just like Lost-or-Stolen efforts, the ordinance will be passed because Philly thinks they can do what they want, and let the courts hash it out later. They don't care one bit about preemption.
They will proceed to arrest anyone with an out-of-state permit/license because the law abiding gun owners from out-of-state are under the belief that they are still legal in the eyes of the law of the Commonwealth (with respect to reciprocity).

Existing code:
§ 10-818. Firearms in Public Places.
(1) Definition.
Firearms. "Firearms" means any revolver, pistol, rifle, shotgun or other weapon capable of propelling a projectile by means of an explosive material or charge.
(2) Prohibited Conduct. No person shall carry a firearm upon the public streets or upon any public property at any time unless that person is:
(a) licensed by the Commonwealth of Pennsylvania to carry a firearm or licensed to hunt;
(b) actively engaged in a defense of his life or property from imminent peril or threat; or
(c) a police officer or member of the State or Federal militia on active duty.(3) Penalty. The penalty for violation of this Section shall be a fine of not less than three hundred (300) dollars and imprisonment of not less than ninety days.

This won't last long if it's passed. Unlike Lost & Stolen, it would be relatively easy for someone to attain standing to challenge this.

Like all the Philly gun ordinances, this would be struck down as soon as they actually charged someone with it (until then nobody has "standing" so the courts won't rule on it).
Interesting wording: in 2 (c) it seems that it will be OK if you're actually using it to defend yourself or your property.
