Smile Can I carry my father's pistol in PA.

My dad and I were going to have his pistol; a Charter Arms .38 Undercover, transfered to me. The clerk at the Dealer we use said in PA you don't have to do this because of "Father/Son" privlages. Does anyone know if this is correct? A co-worker of mine had his father's pistol confiscated in PA while he carried it. It was a traffick stop violation that resulted in the taking of the firearm, and it was held untill his dad picked it up.

PS. Thiis is my first posting, and I realy like this page. Thank You for providing our community with a positive outlook on Firearms!!

Correct, father to son transfers require no "Application of Sale/Transfer" be filled out per § 6111. Sale or transfer of firearms.

(c) Duty of other persons.--Any person who is not a licensed
importer, manufacturer or dealer and who desires to sell or
transfer a firearm to another unlicensed person shall do so only
upon the place of business of a licensed importer, manufacturer,
dealer or county sheriff's office, the latter of whom shall
follow the procedure set forth in this section as if he were the
seller of the firearm. The provisions of this section shall not
apply to transfers between spouses or to transfers between a
parent and child or to transfers between grandparent and
grandchild.

As for your co-worker. If the took the gun SOLELY based on it being his fathers and he has a LTCF like you mention then it was an illegal seizure.

Additionally, if you have a LTCF you can "borrow" anyones firearm, per SS6115

Of course, with no registration, there is no way to tell on the side of the road if that pistol is yours .... I believe firearms registration is supposed to be illegal in PA.

But I could be wrong...... I've been wrong before...... The difference between me and a politician is I will admit when I'm wrong.....

You don't specify what you will carry when applying for a PA LTCF, so anyone's (legal) handgun is OK to carry. As for transferring ownership to you, your dad can give you the gun without recording it with the state if he wants, but if it makes him more comfy, than do it. Personally, I wouldn't, but I'm sort of paranoid about the government keeping tabs on every gun I own. Guns do not have to be registered in PA, and if someday the gunophobics decide all guns do have to be registered, I wouldn't mind having a few around that aren't on record with the state just for my own piece of mind.

Oh yeah, about your friend. There are many laws about how to carry a gun in a car, and having a LTCF doesn't exempt you from all of them. Maybe the cop was wrong, or maybe your friend broke one of the other rules. The best thing for anyone who plans to carry is to know the laws, obey the laws, and maybe even carry a copy of the pertenent codes in the glove box for just such occassions. Cops have a lot of rules and regulations to remember and some just don't know the carry laws as well some people who carry a gun, but every time a LEO walks up to a vehicle they put themselves at great risk, and they'd rather be wrong then dead when it comes to confiscating a weapon.
