SUBJECT: FOAC PA General Election Notice & Update

November 03, 2007

FOAC Membership Status: Invited to Join

Every off year election we stress the importance of gun owners participation. This year is extremely important for a number of reasons and we ask you to consider this when you are deciding whether or not to vote.

The 2007 legislative session has brought a renewed focus of the Philadelphia Legislative Caucus who are riding rough shod over the political process to enact wide ranging gun control measures and are waging, for all intents and purposes, a campaign of political terrorism against gun owners to cover up for the utter failure of the Philadelphia Justice System. Some legislative leaders are attempting to appease them with ‘reasonable’ gun control that has the potential to ensnare law abiding gun owners who will need a fair minded court that understands constitutional issues. Judicial races provide us with the option to improve our chances of fairness in the courts.

The FOAC Voters Guides are now available at www.foac-pac.org and are designed to promote your understanding of our investigation into the candidates positions on our issues and the informed participation of citizens. The Voters Guide listings are based on many factors including material submitted by the candidates.

FOAC Judicial Decision Making Process

By now most of you know that the FOAC process of evaluating candidates is very specific and extremely thorough. In the case of judicial candidates we examine not only their questionnaires but also as many other legal sources and opinions as we can possibly obtain so as to judge their judicial temperament. We are explaining this process because there exists a difference of opinion between FOAC and other gun owner related organizations that have endorsed candidates in the Supreme Court race for 2007.

In essence we agree on the endorsement for Seamus McCaffery but we have taken a different path by endorsing Maureen Lally Green instead of Mike Krancer. In the primary of 2007 we did recommend Mike Krancer and we believe he is a quality candidate however when we examined the depth of material that is available to judge judicial temperament between Krancer and Green the choice for our endorsement was clear and the membership unanimously approved the endorsement of Maureen Lally Green.

As an example, please review the commentary below:

The Committee for a Better Tomorrow, whose treasurer, Mark Tanner, is the current president of the Philadelphia Trial Lawyers Association said, “In terms of Krancer. . .said the group just didn't know enough about where he stood on certain positions because there weren't as many opinions for them to read”.

This viewpoint was exactly what our investigation revealed and was part of OUR (FOAC's) decision making process. Lally Green stood out in this area and we would submit that others to examine this race have not done this kind of research. Our decisions are not based on politics but in choosing by experience and qualification.

Maureen Lally green has received other endorsements as well and I have reproduced some of them below:

PA Fraternal Order of Police

The state’s largest organization of law enforcement officers found that Lally-Green’s experience and reputation as a judge best reflected their organization’s goals and priorities.

“Maureen Lally-Green has the knowledge and leadership qualities we need in our justices sitting on the Pennsylvania Supreme Court,” said PA State Lodge President, Mark Koch. “With our endorsement, voters can be assured that Judge Lally-Green’s qualifications have been fully vetted by law enforcement as someone we trust to serve with honesty and integrity as a Supreme Court justice.”

--FOP Endorsement Letter

Pennsylvania Bar Association

Her opinions are well-reasoned and provide very helpful guidance on difficult issues. In addition, her judicial temperament and impartiality in decision-making are outstanding. She is known for her fairness, courtesy and respect for counsel who appear before the Superior Court. The Candidate also has an outstanding record of meaningful community service. The Commission believes that the Candidate would be an outstanding addition to the Supreme Court and highly recommends her.

Pennsylvania Chamber of Business & Industry

“Judge Lally-Green exhibits an exemplary temperament and understanding of constitutional law that is necessary for serving on the Pennsylvania Supreme Court,” said Gene Barr, PA Chamber vice president of government and public affairs. “She has earned the reputation of a fair and impartial jurist.”

--PA Chamber Press Release

In consideration of the above we ask that you consider Maureen Lally Green for your support and further, that you examine the rest of our candidates in the light of comprehensive approach that we maintain when examining all races, especially including the judicial races.

Further, please examine the choices you have for the Pennsylvania Superior Court and you will see another divergence of opinion. The two choices we have offered you maintain a clarity of thought, concise approach, and philosophical underpinnings that will benefit Pennsylvanians for years to come.

I am attaching to this message all of the FOAC Voter's Guides for your use and dissemination. I ask you to please do your best to urge your friends and family and fellow gun owners to get to the polls on November 6th and vote!

Thank you for considering this important message!

Best Regards,

Kim Stolfer, Chairman
