Probably - and not applicable. This is a civil trial; guilt or innocence as guilt or innocence does not play a significant role. To turn it around - the O.J. civil trial said, basically "for these facts and circumstances" Defendant owes Plaintiff money. Guilt, in a criminal trial sense, can result in jail time (or fines, for those misdemeanors and other statutory offenses that don't have jail sentences involved.).

I don't know if they still allow the practice, but it was the case in England you could hire your own lawyer (barrister) to prosecute crimes committed against you - a true private prosecution.

Interesting, I guess I really don't understand civil law very well. So what types of verdicts are reached in civil court if not guilty or innocent?

Whatever the results of these legal actions turn out to be, their being brought before a court is deserved. Thats a bit harsh for employees. I would accept it as punishment for elected or appointed officials though. Employees should simply pay restitution if possible. Although police do take an oath to uphold the law so I might expand it to any public servant who takes an oath.

Too many posts here that seem to enjoy this. This situation is not good for either party and I have empathy for ALL involved.
I doubt the empathy Dave. You have a fairly well marked trail on a couple of forums of being against open carry. And this situation is very good for the citizens of the Commonwealth if it results in a little less overbearing illegal treatment by thugs in blue uniforms. And while the parties involved may be innocent until proven guilty in a court of law, that does not mean the people who were there can't see what really happened. All it means is that it has not been adjudicated yet.

Your last sentence in this quote negates any truth to your proclaimed "empathy" in your previous quote. And as Headcase has already ably pointed out, if you think this is about a few bites of food, then perhaps you need to find other employment yourself. Cops who think this way are a real problem for the rest of society, even when they are only part time reserve deputies.
