Yes. That was surely apparent from the time he muttered the word "Junior".

    Glad you weren't killed today.

Where is the outrage from the LEO community on this forum about this problem? I understand that a LEO may want to have all the information before making statement, but how many times does this have to happen until they speak up?

Don't people who wear a badge realize that each time something like this happens and they remain silent causes more and more non-LEO to be increasingly suspicious and less trusting of police?

this is a very real and possible outcome. No joking around, these cops are going to kill someone for simply walking down the street conducting themselves in a completely legal manner.

And what's disgusting is the cops would probably get off scott free because their actions were "justified and reasonable" in the aspect of "officer safety"

Go all the way Viper with this one

    Good to hear.

Didn't a memo go out to the PD about OC in Philly recently? I'm thinking you may have had that ace up your sleeve, well more like in your pocket. Perhaps that is the reason you are posting from your own computer while in possession of your property.

"Junior"? Really? What an ass. Luckily there were no discharges while you were looking down the business end of those guns, and no one felt the need to put "two in your melon."

Keep us posted when possible. Stay safe, Mark.

Wish you the best. Glad to hear you're home with all your property.

Interesting to see how this is used by the Philadelphia PD. Could be their idea for a reason for them to continue to push for their own rights to write gun laws.... spinning the truth.

I do not agree with the idea of the City and how is bullies gun owners at every point.

For me there is only one thing to do, move. They will not get my taxes, my votes, or my respect. They will get nothing from me.

Viper be careful. Nothing matters when you're dead my man. Remember the California incident at the subway station.. be good keep us informed.

Not quite. He chooses to OC in Philly.

Unless and until someone wins a lawsuit of enough magnitude to get the PPD's attention, I fear it's not a matter of luck so much as asshats who ignore the law because they can.

If Viper was walking down the street OC'ing as the original post suggests and there are not any details we don't know to the contrary, he will eventually get his stuff back, not be in any danger of a charge or conviction. It may very well cost him money to defend himself and regain his property. It _will_ cost him money to conduct a legal action against the PPD to stop this from happening to people in the future.

They (PPD) know that it comes down to a matter of one's financial ability to fight bullshit charges and (more importantly) undertake a lawsuit that'd end this crap once and for all. And that's why it continues. And thus, I don't think he's any less lucky than anyone else who might OC in Philly.

To the OP--if you survived all of this with an intact audio recording that you current have, I suggest (if you have not done it already) that you get a copy in the hands of an attorney and/or someone trustworthy who is beyond the PPD's reach. If you want, I can arrange for it to be disseminated and protected in a way that they'll never be able to touch, but you really are better off with it in your lawyer's hands.

Edited to add: this, if pressed, will come down to the infamous PPD directive that instructs PPD to disarm any OCer and check to ensure they have a LTCF, on their convoluted theory that it's a potential UFA violation if the cop does not know one has a LTCF. That assumes that all other parts of the stop were lawful (which I tend to believe they were not, based on the known history of the PPD with OCers).
