I've been watching this with some interest.

It seems to me (and IANAL, IAAEngineer) that admitting guilt up front is a dangerous road to travel..."Yes, I did what you said I did. Here's why I think it was not against the law..."

The problem being that if the powers that be don't agree with your interpretation...

You need to read the prior posts. There are no admissions of guilt involved in this type of motion practice. The beauty of this strategy is that you get to test the prosecutions case (and ascertain the trial judge's position) WITHOUT any risk of liability to yourself.

I can tell you that in my own incident, with this exact statute, I am fairly certain that my being able to quote the statute and insist that I was a law abiding citizen carrying for self defense which could not possibly be a more lawful purpose, is why I left under my own power. After, of course, an hour of conversations between the responding officers, the local ADA, the PSP, and somebody in Harrisburg.... and I was OC'ing, at an event full of kids, on school property....

(I was told that if I covered I was free, and if I refused, I would be arrested and processed and could make my case before the judge.... I covered and left)
