legally, wandering into someone's unlocked house is different from wandering into someone's barn. wandering into someone's yard is completely different from either.

the law and legal system differentiate between "domiciles", "curtilage", "outbuildings", "open fields", etc.

it is not the case that property is property in the eyes of the law and courts.

WOW, this thing has gotten really off topic, with alot of what-ifs, and other stories and trivia.
The bottom line is,
"Girouard told police the boxer had wandered near his property and growled at him and his two young children, according to Officer Wayne Smoker.
Girouard took his children inside the house, returned with a pistol and shot the dog."

"When Rice saw his injured dog, he went after Girouard with a baseball bat, threatening to hurt the man, police said."

Brian Girouard, 41, 1741 Hemlock Road, was charged with recklessly endangering another person and cruelty to animals for allegedly shooting his neighbor's dog.

Joshua Rice, 33, 120 Albright Ave., was charged with terroristic threats, for allegedly threatening to hurt Girouard with a baseball bat and a dog law violation for letting his dog run loose.

Seems pretty cut and dry.

Thank you for bringing back the actual topic of the post. The guy could have safely stayed in his house and called the dogs owner. Instead he went back outside and decided to kill the dog. They both deserve what they get. I do feel kinda bad for the dog though.
