This obviously would be completely illegal based on pre-emption, but this is what they are up to!

Hmm I did a search on that, I did not know of this, Mind you, I did not live here back then. Interesting that the city would do this... What did they think they where doing? I am pretty sure starting a fire in a garbage can is illegal in the city, how did they think they could burn out a whole street?

The funniest part (setting aside UFA preemption) is that 18 Pa.C.S.A. 6107 specifically authorizes people who hold 6109 licenses (as most of us do) to carry during emergencies declared by any "state or municipal governmental executive."

By declaring an emergency, Nutter'd be reaffirming CC rights, not limiting them.

Can you provide a direct link to that? I can't find it in the PA Code.

Default Re: Philadelphia: Nutter Proposes Crime Plan that stops sale, posession, carry of firea

here is a copy and paste right out of the crimes code regarding that statute in question.

§6107. Prohibited conduct during emergency.
Statute text
No person shall carry a firearm, rifle or shotgun upon the public streets or upon any public property during an emergency proclaimed by a state or municipal governmental executive unless that person is:
(1) Actively engaged in a defense of that person’s life or property from peril or threat.
(2) Licensed to carry firearms under section 6109 (relating to licenses) or is exempt from licensing under section 6106(b) (relating to firearms not to be carried without a license).

Nutter and Bloomberg from the same gene pool?
