Wow. After reading that report, this is going to be a very good case test of PA's law which outright outlaws any form of firearm registry.

On 9, May2008 at 1829 hours officers received a dispatch to Old country Buffet restaurant on Commerce Blvd. for a report of two males in the restaurant with guns on their sides. The caller stated that the males were not doing anything wrong but the guns were on their sides visible and there were no badges displayed and felt this was wrong with children running around and requested police to check on it.
Emphasis mine; oh, wow.

Report was pretty disgusting.

Taking their time and trying their best to spin this their way.

I believe the police report, while it IS suppose to be the view of the officer filling out the report, has been rewritten with help from others.

The officers seem to have been trying to handle this the best way they knew how. When they contacted the DA and got really bad legal advice is when this went from bad to unlawful. To me most of the charges should be directed at that person. He DOESN'T know the law and should not be in a position to tell police to violate the law. I hope that this takes him out of his job and disbarred.

Same for a police chief for talking about the registry of guns as if it's complete, necessary or reason to steal property. Wrong, wrong, wrong. This is why I have a problem with the governments involvement in regulating RIGHTS.

If the other responding officers heard the DA's comments on the radio and knew it was illegal then I can't blame them for standing back. I wouldn't want to be involved in that either. I might have even got in my car and drove away as fast as I could.

I'm sure there are many more laws broken and lots of things done wrong but the DA is the person that most of this should be focused on. The foot soldiers were following orders and if they knew it was wrong they are part of the problem.

You know what cracks me up? These bozos had 10 days to confer with DA,s and create some kind of cover story / propaganda piece. This is the best they could do? They still come off as a bunch of bumpkins who don't know the law or what they are doing.

Can you imagine if Karen Gallagher wrote the truth.

Or in the Dickson City vernacular........That's not right ,.. heyna

Does a C&R license count as an FFL license in this case?

These Guys are a Bunch of MAROONS, (to steal Bugs Bunny's line). They not only show up with guns exposed on their hips, sit with their families, near my table, but they say they are just like any father protecting their family. My kids were the first ones to notice them, I thought at first they were Policemen, but then when I asked the service Manager of Old Country and she didn't know anything, I asked the guy sitting two booths down from me and he gave me that line about being a father just like me. SORRY chum, your nothing like me. I was one of the people that called 911, and when the police came they asked me to wait. I got to see all these guys come out of the restaurant, some pushing out their chest, others TRYING to push out their chest but couldn't, it was funny to watch at first, spouting of about their rights, but then this rather elderly rotund guy, removed his gun, and ejected the clip and started playing with the bullets it became Scary. I for one will not return to Old Country Buffet do to them tolerating them being their, letting them back in and apparently they let them in again a couple days later. I would hope other people would stop going to, and yes we used to go to Old Country buffet a Lot!

I'm the guy/table he stopped to talk to.

Hmmph. I did a fine job of it as well. The DAD sounded supportive. He said his boys (ages 9 to 11ish) were frightened. I explained that I was a normal guy. A daddy just like their daddy. I play catch, help with homework, and go to restaurants just like you have with your father.....it's just that I happen to be wearing a firearm. No, OC isn't entirely common, but there are thousands and thousands of firearms owners/carriers in Pennsylvania. The exchange was not lengthy, but didn’t appear negative.
I wished them a nice evening and they left.

Go figure.

you know, it occurs to me that kids would not fear guns if their parents did not teach them to fear guns.

so, yeah, of course your kid was afraid. you told him to be afraid...or you let his teachers or the mass media tell him to be afraid and never corrected that.

i am so very thankful that my parents taught me to respect guns...not to fear them.

I know I get scared when I see someone open carrying bullets outside of the gun.

This was in an email I get.

Quote:
Police Erred in Pennsylvania Open-Carry Incident: Police officers and prosecutors seemed either unfamiliar with the law or unprepared May 9 with how to handle a dozen customers at Old Country Buffet who were openly carrying guns, a Dickson City police report shows. But Assistant District Attorney Corey Kolcharno said he and police handled the situation as best they could given that one customer had not fully cooperated with police. That customer, Richard Banks, of Mountaintop, had his weapon confiscated for not carrying a concealed-weapons permit and was initially arrested for disorderly conduct and failure to carry a license for the weapon. Mr. Kolcharno said that might have been avoided had he known Mr. Banks was a federal firearms dealer, exempt from carrying a license for a concealed gun. No charges were filed against Mr. Banks…
