Although there is no gun registration system in the state, police can verify information about the gun through a state police database of gun sales and other databases, such as one for concealed-weapons licenses.
Did everybody else miss this? Since when is there a database of LTCF in this state that ties us into specific weapons that we own? Since when?

I won't even say anything about the "concealed weapons" bit.

(b) Exceptions.--The provisions of subsection (a) shall not apply to:
Any person engaged in the business of manufacturing, repairing, or dealing in firearms, or the agent or representative of any such person, having in his possession, using or carrying a firearm in the usual or ordinary course of such business.
Define usual or ordinary course of business.
  1. A business meal "is" normal business
  2. Returning to the store or shop (or home) is part of normal business.
  3. Although a Federal Firearms License is attached to business hours, no one can say what time or where one can meet others and talk about business.
  4. a business man who owns and operates a business can be called upon at any time to return to his business. therefor making his business a 24/7 carry situation. Certainly if an alarm company called Mr. Banks, he would return to his Business even if the hours on the door stated he was "Closed"
The original provision was and still is that a FFL needs to be able to carry to protect both his investment and himself from being taken hostage and robbed.
Although this may not have happened during business hours, the authorities will often tell you they agree that any FFL should be armed as to not become target to an invasion type kidnapping where would be robbers could take the person back to his shop to forcibly open shop.

When a check was done on Richard Banks, although there may have been more then one return on the name, the mention of Federal Firearms License should have been attached to at least one of them leading the police to think they may have to ask about this situation to clarify it with him. Same would be true of a representative of his company although it would not automatically come out in a search for a name.

It wasn’t a rash decision,” said Mr. Kolcharno, who initially approved charges. “We were cautious to protect the rights of both those openly carrying and those lawfully carrying a gun, but also the legitimate concern for those (at Old Country Buffet).”

So I am to understand that Open carry of a firearm is unlawful? Dickson City is a city full of morons, who elect morons to govern them moronically...

What I like the most though is the obvious CYA crap from the ADA and the Chief of Police. Based on their statements alone I would have to say that if/when a case is brought against the PD they are very purposefully going to hang officers Gallagher and Mariano out to dry. Never mind that this kind of malfeasence(sp?) always flows down from the top.

These OC mafia guys are just looking for attention. They think they are tough because they carry a gun. Most of the OC crowd are full of hot air. Keyboard commandos at best. I carry concealed 24/7.

A reminder that this is all irrelevant since I had my LTCF.
They did not know I was FFL until after I was released. Which was long after disclosing my LTCF and them checking it.
