Default Landowner charged with gun threat on boy, dad

This is kind of old school land protection. Would this action have been justified if this guy didn't point a gun at a twelve year old?

"A Washington Township man is accused of brandishing a shotgun at a 12-year-old boy and his father Friday evening after he became angry that the pair were using his property for winter recreation, police said Monday.

State police at Belfast charged Glenn William Nehoda, 53, of 1031 Jacktown Road with aggravated assault, terroristic threats and recklessly endangering a minor.

Nehoda became angry when he saw the father and son riding a snowmobile and all-terrain vehicle on his property at about 7 p.m. Friday, state police said.

Nehoda, who has a license to carry a concealed weapon, allegedly confronted the pair, pointed a shotgun at the 12-year-old and told him to shut off the vehicle.

The father called 911, but the dispatcher was only able to get partial information before the call was disconnected. The dispatcher called back several times, but no one answered, police said.

State police were able to track down the location of the call, but the father and son had already left. Nehoda told troopers about the incident, saying that ''he will protect his property,'' police said.

The father later contacted the state police and filed a formal complaint, which led to the charges.

Nehoda was arraigned before District Justice Adrianne Masut of Wind Gap Saturday and sent to...."

Once again we have VERY few details. Did these two trespass on previous occasions? Did the property owner warn them not to trespass? The guy didn't shoot them or assault them, but he did point a gun at them. That wasn't very bright. He should have just filmed them tearing up his property and filed complaints against them.

If this were Texas, this wouldn't even be an issue.

If they charged him with that, they are really good... no such charge exists in PA statute to my knowledge. There is recklessly endangering another person (M2), or endangering welfare of children (M1 or F3).

What does it really matter if the guy had a LTCF? he was on his property and using a shotgun. They just had to throw that little "dig" in there.

Anyone who rides a smowmobile on someone elses property without permission is an asshole. If you're going to do an asshole thing on someone elses property, getting a shotgun pointed at you is a real posibility. People have no respect for others land anymore.

Jeezus, I had to throw some kids off my property years ago and I was carrying a shotgun. However I've always known to never point a weapon at something unless I planned to destroy it. Just the presence alone is enough of a deterrant IMO

Need more details to form an opinion.

Was the land posted?
Were they repeat offenders?
Did they destroy any private property?
Did they make any threatening gestures towards land owner?
What caused the landowner to point the weapon?
Was there a full moon?

if signs were properly posted, in my eyes he is in the right... no signs, or poor signs then he is wrong about his WAY, but right in the idea.
