Default McCain-Feingold Revisited By SCOTUS

From www.nytimes.com/2007/04/26/washington/26scotuscnd.html:
Quote:
The Supreme Court put defenders of the McCain-Feingold campaign finance law on the defensive today in a spirited argument that suggested the court could soon open a significant loophole in the measure.
The loophole mentioned is that of corporations (such as the NRA) buying television "issue" ads that mention candidate names. The current case is an as-applied challenge rather than the facial challenge that was denied in 2003. Justices Roberts and Alito seem pro-1A, so I'm expecting a 5-4 ruling in favor of free speech.

Default Re: McCain-Feingold Revisited By SCOTUS

McCain-Feingold is just plain bad law and needs to be completely overturned. The last time that it made it to SCOTUS it was upheld but it has never really been argued on the grounds that it should have been, the first amendment.

Yesterday the Supreme Court ruled that part of McCain-Feingold, as applied, is unconstitutional on First Amendment grounds.

The Court's official Opinion in the case (FEC v. Wisconsin Right To Life, Inc.) is available at:
