Default Update: Lawsuit win: GeorgiaCarry.org Sues Sheriff for Open Carry incident

http://www.georgiacarry.org/cms/2008...-gun-incident/

Quote:
GCO filed a federal lawsuit in the United States District Court for the Southern District of Georgia against the Sheriff of Richmond County and a Richmond County deputy who detained a GCO member and seized his legally-carried pistol. After checking it to see whether it was stolen, the deputy confiscated the firearm until “proof of purchase” could be provided, and the Sheriff’s Department then refused to return it. The deputy insisted that it is against the law to carry a pistol openly. This sort of police misconduct is fortunately rare, but it is becoming more common as more Georgians begin carrying firearms.

Update that was posted on the OCDO thread:

GCO email update:

Man With a Gun News

In other news, at the first hint of lawyers, the Richmond County Sheriff's Department miraculously located Mr. Mead's firearm within a few hours (oops, guess it really was not at the GBI after all, as they had claimed) and returned it to him. The lawsuit is moving forward.

No wonder this country has such a high lawyer-per-capita ratio... employing the services of a lawyer seems to be the only way nowadays to get LEOs to follow the law. (sigh)

There's that, and then there are things like www.whocanisue.com. I think both are a cause for an explosion in lawyers.

Please tell me they aren't letting this drop just because he got his pistol back though.

I saw no indication of that. Actually, the update says "...The lawsuit is moving forward."

Default Lawsuit settled

UPDATE:

Open Carry Lawsuit Win in Georgia:

http://www.georgiacarry.org/cms/2008...a-gun-lawsuit/
Quote:
GCO Settles Man with a Gun Lawsuit

GCO settled the federal lawsuit in Richmond County involving Staff Sergeant Zachary Mead, who had his firearm seized while carrying it openly outside Kroger. Richmond County consented to an Order declaring the seizure to be a violation of the Fourth Amendment, paying damages, court costs, and attorney fees. More importantly, Richmond County has assured GCO that it has no policy of detaining Georgians merely for carrying a firearm. You may view the Order here.
