No street adjacent sidewalk in a city is private property. I don't care if your hotel's canopy is over it, its public property.

Let's not forget that I can tell you to cease and desist posting here but that it carries no particular weight. I suppose I could also allege you're posting on a board that you're not supposed to post on, even if I'm wrong or lying.

I imagine any hotel manager would shoo someone harassing his/her patrons, whether or not it was with particular legal weight.

if this really did happen on the "sidewalk" then i am as outraged as everyone else--i really am...the erosion of free speech rights in this country and erosion of transparency in government is downright scary.

but, if it actually happened on private property (e.g., the little pull up driveway loop for parking while checking in/dropping off luggage many hotels have), then it's a different story. the erosion of private property rights in this country is also downright scary.

i'm really not making a judgment one way or the other because i don't know what happened. i don't necessarily believe the media when they say it happened on a public sidewalk, and i also don't necessarily believe the police when they say it happened on private property.

it wouldn't really surprise me either way. it wouldn't surprise me to find out the "public sidewalk" was really the private walkway right outside of the hotel that is not along a street, but along the private drive of the hotel...and the "street" to officer pushed the guy into was that private drive and not actually a street.

it also would not surprise me to find out that it really was a public sidewalk and an actual street.

either one is equally possible.

You make a good point. I suspect it was actually a combination of the two. The guy probable started on the sidewalk and worked closer to the action. Was told to leave. Didn't and the police came and removed him. Then two hours later he was arrested across the street for continuing his picture taking and this caused him to get arrested.

That's why he was arrested. LOL!

I haven't seen the video ThomasJ, so I can't say what level of force was necessary to aprehend the guy, but I tend to agree since I don't think he should have been arrested at all.

That's the point; the manager can say whatever he want even thought he doesn't own the public sidewalk in front of the hotel.
