Here is story about pending legal action against the PSP with a PAFOA member Kim Stolfer mentioned. Also in article is my former very Pro-gun state Rep Marc Gergely and George Romanoff, owner of Ace Sporting Goods talking about how negative its going to effect everyones FFL dealers business.

http://www.pittsburghlive.com/x/pitt.../s_523360.html

For everyone in western PA, that has Comcast cable with PCNC news on channel 35. PAFOA member Kim Stolfer will be on with Night Talk host Mike Pintek on Thursday Aug 23, 2007 at 8:00 pm and reruns at 10:00 pm of same show. Please try to watch it possible, if you never had the opportunity to listen to Kim Stolfer speak on gun owners direct political action, you will find it very interesting.

Quote:
TITLE 18 PA CRIMES CODES
§6111.1. Pennsylvania State Police
(2) In the event of electronic failure, scheduled computer downtime or similar event beyond the control of the Pennsylvania State Police, the Pennsylvania State Police shall immediately notify the requesting licensee of the reason for and estimated length of the delay. If the failure or event lasts for a period exceeding 48 hours, the dealer shall not be subject to any penalty for completing a transaction absent the completion of an instantaneous records check for the remainder of the failure or similar event, but the dealer shall obtain a completed application/record of sale following the provisions of section 6111(b)( 1) and (1.1) (relating to sale or transfer of firearms) as if an instantaneous records check has not been established for any sale or transfer of a firearm for the purpose of a subsequent background check. (Chgd. by L.1997, Act 5(1), eff. 6/21/97.)

The law is crystal clear, has nothing to do with a request by a dealer, this clause was put in there by pro gun people just to prevent a so called computer problem stopping an exercise of a Constitutional right. If this clause was not in there what remedy is there in the law would anyone have over the PSP allegedly having a computer “problem” that shuts down PA instant check system for more than 48 hours why could it be down for 33 days or more?

As a side note why do we need the PSP to charge us to run this state system when the Feds instant check system would do for free, wouldn’t the PSP limited money resources be better used to fight crime instead of spending money to register PA gun owners?

I know lots of PA gun owners are not involved in political solutions to gun ownership, sometime all you can do is put something in a law that stops or prevents a possible future abuse here is a case in point, its same way we have been getting all of these reciprocity agreements. So much more political solutions are possible, except for lack of direct involvement by gun owners.

Go reread Kim Stolfer post here on how to we have been getting solutions

Because if they got rid of PICS they then would have to get rid of their illegal registration system.

For those that might not get the NRA news alerts via email ...

Your Attention Is Needed Regarding A Column In The Pittsburgh Post-Gazette!

Dear Pennsylvania NRA Member:

NRA-ILA wants to call to your attention a column that ran in the August 22 edition of the Pittsburgh Post-Gazette, written by Eric Heyl. In his column entitled “4-day wait may have hunters out of arms” (www.pittsburghlive.com/x/pittsburghtrib/opinion/columnists/heyl/s_523377.html), Heyl attacks gun owners and hunters on the issue of the impending 4-day shut down of the Pennsylvania background check system. Heyl takes a harshly arrogant and sarcastic tone that clearly shows his disregard for Second Amendment Rights and his disdain for anyone who exercises those rights.

Heyl’s arrogance didn’t stop there. When contacted by an NRA member about his insulting tone, Heyl responded:

Yep. We all have our opinions. The difference between us is that I happen to get paid for mine.

Thanks for reading and taking time to share your thoughts.
Regards,

Eric Heyl
Columnist
Pittsburgh Tribune-Review
(412) 320-7857

NRA-ILA understands the need to maintain and improve the computer system for background checks, but feels strongly that these upgrades can and should be done during off hours and certainly not during the days running up to fall hunting season.

Take a moment to read his insulting column and then contact Heyl (eheyl@tribweb.com) and his editor, Frank Craig (fcraig@tribweb.com) and Managing Editor Robert Fryer (rfryer@tribweb.com) and politely let them know that you believe your rights deserve better than to be ridiculed and dismissed.

Wonder how he'd feel if the newspaper offices were arbitrarily shut down by the state for 4 days, depriving him of his constitutional rights?

*Edited to add:

Guess I should just ask them....e-mails sent to all three parties. I'll post any replies that I receive. What I sent:

Quote:
Mr. [fill in the blank]

As a firearms owner in PA, I do not appreciate the dismissive tone in Eric Heyl's recent article regarding the PICS shutdown.[This sentence only sent to the editors]

I'm curious if you'd be supportive of your newspaper offices being arbitrarily shut-down by the state for 4 days, depriving you of your 1st Amendment rights during that period?

Also, it's worth noting that existing law already allows for such outages and the stated upcoming prohibition of gun sales during this 'upgrade' violates the law:

I'm a pretty sarcastic prick most of the time, but I can't tell if Heyl’s article is truly Anti.

Sounds to me like he's saying they(state) could have handled the "shutdown" in a better way.

Maybe I'm not reading this correctly?

Montanya, I'm having trouble following your post above as well... maybe I'm just losing my mind?

Said on the news tonight that they are working on another system so gun sales can continue. Guess the sportsman's of PA spoke up after all.

I wrote Eric a nice letter. Hope the rest of you will take the time to let him know how much we appreciate an article like that one.

Read it again EM. He is not being nice at all to Gun Owners. If that is sarcasm, we can do without it.

Don't know if anyone saw PAFOA member - Kim Stolfer on TV or listened to any of Kim's recent radio interviews across the state about pending PICS shut down.

Kim Stolfer announced the filing in Commonwealth Court today of the PICS Injunction against the PSP brought by the Allegheny County Sportsmen’s League and 26 gun dealers throughout the state of Pennsylvania.

It always struck me funny till someone files a lawsuit; no one in government ever wants to obey the laws or wants to do the right thing. "Do as I say and not what I do" seems to be most government people motto.

Allegheny County Sportsmen’s League web site with numerous firearm related information, you should all take the time to read Kim's excellent Legislative Committee monthly Reports.

http://acslpa.org/

ACSL Listing of all proposed gun bills in pending in Harrisburg (good and bad) are available here.

http://acslpa.org/n-legislative/pa_p...egislation.htm

Thank you to ACSL, the 26 FFL dealers who stepped up to do the right thing and special thanks to Kim Stolfer for spearheading the counter attack against the usurpations of our Constitutional rights.
