My argument is based entirely on pointless law. If it were up to me, no license to carry would be required to carry, open or concealed.. And then the sheriff would have no authority to revoke such lawful ability.

While I agree it's not the Sheriff's fault, one would think that an investigation into one's character would require PROOF of a defamed character, not just hearsay.

This is just one more reason why the LTCF licensing statutes should be changed to require the Sheriff to provide proof of such dangerous character, instead of just being allowed to use the character clause as a catch-all to deny anyone he doesn't feel like issuing to.

And don't even get me started on the BS Check-Card crap. IMHO, the Sheriff deferring his responsibility to the local PD is negligent at best to his responsibility as the issuing authority.

Hahahah that's true, too. Our entire discussion was based on a false premise - that gun control of any kind was even lawful. lol...

The problem was there was no investigation, no interview of referrences, no discussion with me, and no proof or understanding of my family issues (two special needs children). Therefore the judgement of character relied on the LEO who did not know me personally or the full story of my family challenges.
As the Gunlawyer said, the sheriff has a good attorney who understood the burden of proof on them to prove the character issue. People who know me would testify that my character is excellant.
The main point is in a government system, this happens even though it shouldn't, and a good lawyer early on can help alot by tackling the law and politics, while taking the emotions out of it.
Also, sometimes it is better to know you have won, and leave it as that. A libel suit would not make sense, the LEO only talked to the sheriff's department, so he did not ruin my reputation as no one else knows except through this board.
Their concern was the children, which does not make sense, since I have always own guns at home. Most of the time, government does not make sense.

I'm not saying a libel suit is definitely for you, and since you would likely have to front the money for such a suit, it probably isn't for most people, but just because you think the LEO only talked to the sheriff's dept. is not a good reason not to sue for libel. The simple facts that he told untruths about you and you suffered mentally from it is enough.

I do hope you make a formal complaint to the appropriate authorities about this police officers grossly inappropriate conduct. You can do a great service to the other residents of Harleysville. If you do nothing, you are not helping all the rest of the people in getting government agents to do their jobs and not mess with the citizens. If he did it to you, he has done it to others and will do it to more unless he is stopped. A complaint by you might just be the push he needs to stop lying. Even if not, it puts authorities on notice that this police has a problem with the truth and might help out the next guy who doesn't have gunlawyer on his side. Please strongly consider it.
