Kim Stolfer, FOAC chairman and ACSL legislative chairmen got the advance warning as this posting on 7-9-09.
Here are the details that are known at this time, I will update this posting as they become available.

All AR-15 owners take note:
The PA governor has instructed the Pa State Police to send letters to all FFL within approximately the next two week with the following directive.

That ALL AR-15, not just register receivers, including fully assembled long gun AR-15 type firearms as to be handled as pistol transfers. This will also affect all private sales of AR-15 since the PSP are going to be treating all of them as pistol transfers. So if you want one or want do a private sale get it before this goes into effect.

The problem for dealers to comply with this PSP / governor “created” regulation they will be in violation of section 6111 with this put the FFL dealers in a potential legal nightmare. IF the follow the PSP regulation they could be prosecuted for 6111, which is an ungraded offensive, the default of any ungraded offensive in Uniform Firearm Act in title 18 kicks in which is a misdemeanor one, prohibited from owning firearms.
(FFL dealers are not to record or write down long gun transfers information like they do for pistols)

This is another criminal act being done for political motivated reason, same as the illegal firearm database/ registered firearms the PSP maintains at tax payer expense, the instant check shut down etc all breaking state firearm laws, that if you violate the firearm laws you go to jail for, but the PSP leadership will NOT as usual be held accountable for breaking. .

Yet another reason to contact your legislators and ask them to support legislation to remove the PSP and PA Instant Check System and replace it with the national NICS to take the state politics out of firearm transfers.

I will be seeing Kim tonight after the ACSL meeting to get updated info detail about this breaking news along with a organized plan of action for us to take to stop this from happening.

Forgive my ignorance of the Constitution of our Commonwealth, but how can Fat Eddie of the PSP order enforcement of a law that doesn't exist?

Neither the governor nor the PSP can PASS LAWS; that is limited specifically to the legislature.

I don't get it, unless they change the definition of a firearm it doesn't qualify as something that needs to get transferred using an FFL?

I mean I get the PSP bullying Gander Mountain, but trying to enforce it as law when it clearly isn't seems a bit nutty even for Rendel.

Have you been paying attention?

This has been "enforced" for some time now. Rifles(AR-15s)are being handled as handguns on paper. Just ask anyone who's purchased an AR-15 in the past several months.

It's bullshit and it will continue until they are forced to stop.

i just bought one not too long ago, does this mean i could technically convert it into a pistol without going through any channels? now im going to have to go look at my paperwork dammit!

The only way for us to get rid of the PICS system is to revise subsection 6105 to eliminate the additional disqualifying violations that PA has imposed on top of the federal DQ's.

The FBI's NICS can only operate with the federal DQ's and doesn't account for additional state requirements. If we got rid of PICS without getting rid of 6105, someone could get wrongfully approved but be legally disqualified from owning under state law.

Pennsylvania's own laws requires we use a POC system, ...PICS.

What does this mean for stuff like the FN scar and MR 556 / 762?

What does this mean for g3s and FALs???? What about M1 Carbines?

I honestly think they're pissing up a tree with this one and this is going to end up in court.

I keep reading about this, but I bought my AR in May and the FFL did not make me fill out a SP4-113. I even asked him about this new "law" from the PSP and he didn't seem to know anything about it... <shrugs>
