Default Hi-Cap Magazine Purchase

Is identification required to purchase magazines in Pa.? If so, will a Pa. dealer sell a hi-cap magazine to a New York resident where capacity is limited to 10 rounds (or in some instances 5 rounds)? I assume a dealer would not sell an AR-15 with a 30 round magazine to a NY resident whose only proof of residence would be a NY drivers license.

It is legal for a NY resident to purchase a rifle in a contiguous state and return to NYwith it, but we have the leftover AWB provisions restricting capacity. I was merely wondering if someone in NY could purchase say a Mini-14 in NY and while on vacation in the great Commonwealth of Pennsylvania stop in to a local gun shop and browse the array of hi-capacity magazines available with an eye toward purchase if one was willing to accept the risk back in NY.

There is no identification required to purchase magazines in Pa. nor are you required to show identification to purchase ammunition.

You can go ahead and sell hi caps to NY residents if you want, as long as the transactions are in PA. NY law only applies within NY's borders.

I'm sure some civil suit could be brought against you if it can be proven that you KNOWINGLY sold a hi-caps to a New Yorker with the knowledge that they intended to import them into NY, but that's unlikely. Stranger things have happened, though...

Thank both of you for the response. BTW, I'm not the dealer, I live in NY. I wouldn't get sued, but could possibly get arrested. My dilema is whether to risk that possibility if I kept the hi-cap mags in my home for use during extreme conditions. I would never take them into public when practicing. I would stick to the "legal" capacity magazines. Just have to reload more often. Under certain circumstances, you can understand where you might not want to have to drop a 5 round mag to insert another, and possibly another.

Another way you may want to consider addressing this is to become more politically pro-active. Round up people in your area to vote pro-second amendment, hold a rally, petition your legislature.

Get the hell rid of Schumer and Clinton.

Don't ask your servants if you can please exercise your supposedly Inalienable right that shall not be infringed, tell them you will exercise it, and run those who can't understand that out of your state offices on a rail.

The power of the people can only be felt by them, when you take away their cushy jobs, at the polls.

Here's a question, why do they ask to see my DL every time I buy pistol ammo at Walmart? They aren't checking my age just that I'm a PA resident. Is that PA law or just a Walmart thing?

It's a walmart thing. Some states require it. thus all walmarts require it. central programming you see.

Yea walmarts funny like that but there is a cool trick invovling pistol ammo, self checkouts, another item that requires identification and extremely busy checkouts....

Usually if you order magazines or ammo online they ask for your DL so they can make sure their not shipping into those occupied territories...

On a related question: I just bought five 17-round magazines online for my Sigma SW9VE. They're stamped "For Government and Law Enforcement Use Only." Am I right in assuming that the restriction is no longer valid? Since the 15-round mags the gun came with are legal, I can't see why 17-round mags wouldn't be.
