I'm potentially changing jobs/locations and looking at a possible daily commute into New Jersey. Obviously I'm not considering moving there, the number of standard capacity (16 rounds is NOT extended capacity) mags I'd be bringing with me would automatically setoff an alarm somewhere in Trenton. My question is, from everything I've read there's almost no chance of a CCW equivalent for an out of stater, so is there any realistic/practical legal to carry, any loopholes or that sort of thing?

I had a job offer in Northern Joysey but I turned it down. I wasn't going to live in that Socialist State. Luckily, I got a job offer here in Philly right after. Ah, the smell of cheesesteak and gunpowder, I jetted here quick, he he he.....

Kinda hard for a non-resident to carry in NJ given they don't even let residents carry (unless you know a judge, of course).

I would suggest even thinking about pondering the possibility of having the idea of carrying a firearm in NJ. It is occupied territory.
My ex girlfriend's father who was a Chief of Police for about 20 years couldn't even get a carry permit when he retired if I remember correctly.

There is no provision for out of state residents to get a permit to carry in NJ, before the federal law was passed NJ didn't even recognise active duty cops from out of state, unless they were on duty and notified the county prosecutor first or were in fresh pursuit.
Also dum-dum bullets are outlawed, weather or not you have a gun with you. The law describes dum-dums as{ any bullet designed or intended to expand, enlarge or flatten on impact} for violation you can get up to 18 months in state prison. Retired NJ cops can get a permit now if they apply within 6 months of retirement, qualify twice a year and are under 70 years of age. When they passed this law I had retired and moved to TN so never appied and am now in eligable. Please note, even if you have a permit no so-called dum-dum bullets are allowed they are restricted to currently employed cops only, but are legal in your house, business at a range or in the trunk when going by the most direct route to and from the range or place of purchase. |

I live about an hour drive from the NJ border and about twice a month have to go across the border about 2 miles. I asked a PA officer at the border town about a safe location to leave the gun when I go over. (Like the station house) I come back after midnight. He said just remove the clip and put both in the trunk and I should be OK. Yea right. If something were to happen and I were to be found out they would throw the book at me. A retired NJ officer told me to say I was in route to his house to go to the range. Or going home from his house after a day at the range.

The retired officer is trying to conform it that provision{ in the most direct route } that means don't stop for coffee, or your girl frinds house, it is supposed to be by the MOST direct route, your sceniro would probably work if the retired cop spoke up for you but it might be after some egomanical rookie pinched you for it.
And if you think NJ gun laws are tough you should see the NJ Prevention of Domestic Violence Act, As soon as I was eligable for a pension I moved out in less than one month!. Last edited by Montell C. Williams; April 2nd, 2007 at 03:26 PM. |

The way it was explained to me by an NRA instructor who is an attorney and several NJ State Police…
In Jersey you can have a gun in your place of business legally. There you can carry it open or concealed. You can also go to a range and back home. When transporting in Jersey, you should follow Title 18 United States Code Chapter 44, SS 926A. Basically, locked and unloaded in the trunk and ammo locked separately. It is best that you double check this with the local NJ State Police Barracks, ask for the officer who handles carry permits. In my case, I contacted NJ State Police Troup B in Andover and spoke with a Sergeant Meehime (don’t know the spelling of his name). I sometimes shoot in Paterson with my instructor, an attorney, who suggested I gat a name (and I did!). The Sergeant will be my go-to person if I ever need to. Remember, transporting to and from work is not going to dinner or the mall and I would only take it out at the range or work. When I get to Patterson it’s a little rough there so I usually unlock my bag and have a clip handy before crossing the street to shoot and when leaving before getting back in the car. I also transport to and from by brother’s house in Woodbridge. The test is, if it is legal to have where you are coming from and legal to have where you are going, then you can legally transport it back and forth. Call the local State Police Troup that is responsible for the area you work in – and get a name for future reference. |

I called the Hope barracks regarding this issue a while back.
Nj does recognize peaceable journey. So if you are traveling to nj and have a legitimate reason to have a gun, and it is stowed properly before you enter nj, your good. Legitimate reason would be going to a shooting range or in my case to visit family just over the bridge. You can't go driving around wilt it bouncing around the trunk of your car for a week. To and from your destination only. When I got where I was going the gun was stowed safley. This is what I do. Call the local police where you will be staying(and don't let them intimidate you) get officers name remove the mag unload the mag store the gun in a locked case in your trunk store the ammo also in a separate locked case I keep a case in my truck at all times for my weapon and ammo just because you never know. It is also a good idea to either remove the slide to disable the weapon, or as I do, put a cable restraint through the barrel or cylinder as the case may be. Hollow points are very questionable. When I spoke to the NJ SP they said I could not have them. I then told him that I have a legal right to carry this weapon 3/4 of the country and I got hollow points in it. And he conceded. I carry them. I'm willing to take the chance. There is no law that states the ammo must be locked just stored separate from the gun. I lock it because I have the hollow points. Stay away from exotic ammo. AK or assault weapons forget it leave them home I am not sure if this site has a copy of the federal statute for peaceable journey. If not go to packing.org Print a couple copies keep one with your vehicle reg. and one with your piece. Many LEO aren't even aware of it. Well there it is. It's absurd, but at least you can keep you weapon with you. Sort of. At least Jersey recognizes peaceable journey. NY will throw you in jail if you have your weapon as described above unless you have a carry permit and the state you are going to accepts that permit. I sure it's not enforceable, but it'll cost you a fortune to fight it. Only NY thinks it can supersede fed. statute.
