Default End a debate: Transporting a rifle when on a motorcycle

Ok I got in a debate today, A friend wanted to follow me out to a range to shoot his Mosin-Nagant on his cycle. He ended up catching a ride with someone else in a truck, but if he would- how?
If he had it in a soft case on his back would it be concealed?
If he had the bare rilfe slung on his back would it be branshing? Or at least not a good idea?

It doesn't really matter either way, since he is transporting a long gun by vehicle, the weapon and ammo still need to be seperate.

Open/Concealed is not the issue here as there is no state law against concealing a long-gun.

As long as the rifle is not loaded, strap it to the bike and go. What's the problem?

There is no "brandishing" law in Pennsylvania. While I agree that an uncased rifle slung on his back will attract unwanted attention, I don't think it's illegal. He is simply transporting a firearm as best he can on his vehicle.

Comment:
The law regarding "carry in a vehicle" does not apply to long guns, as they do not meet the definition of a "firearm" as it applies to 6106. 6106.1 prohibits the carry of loaded long guns in a vehicle, even if you are licensed.

Thus, "concealed" is not a legal concern. Also, there is no legal charge of "brandishing" in PA. Whether cased or not, and regardless of licensing, long guns must be unloaded while being carried in a vehicle.

I'll look up those codes later today. I guess we would ok in PA now VA on the otherhand.....

As long as it's unloaded (No magazine in it) and the ammo is stored in a seperate "container" (a cardboard box, or the glove compartment. Perhaps the trunk?) you are legal to do that.

that would actually be illegal as well since there is a magazine inserted in the mag well.

(ETA: er, actually, maybe there isn't maybe that is just part of his jacked i was thinking was the magazine...this monitor sucks...not sure.)

Having an empty magazine plugged into the Kalishnakov keeps all sorts of unwanted dirt from blowing into the rifle. Not illegal. Looks illegal, but not illegal in Pennsylvania.
