Action alert on HB2011 regarding Pre-Emption

Rep Mike Turzai has committed to move HB 2011. This bill strengthens pre-emption by providing for standing and compensation of expenses in the event a local law needs to be challenged that conflicts with State gun laws. Corbett said he will sign if it is put on his desk in the remaining 11 days left to the legislative session.

Hollowpoints and regular capacity magazines are legal in PA. Occasionally, cities attempt to enact illegal laws that are contrary to state law. But the current Philadelphia DA has said that she will not enforce Philadelphia's illegal laws.

I guess you've already learned that the police are not as familiar with PA firearms law as we would like. Hopefully this site will help you to increase the police batting average. Welcome to the forum.

Yes, HP rounds are perfectly fine.

You will not find a law that says they are "legal", because laws only state what is not legal.

I have a 33 rd mag for my G19. You're welcome to borrow it for carry.
It's perfectly legal, but you'll look like a dumbass with it holstered.

Welcome to the forum.

as noted, hollowpoints are legal in PA...and you can get yourself a 33rd mag for that G19 if ya want...though that might make it a bit tough to conceal.

welcome to the land of the free.

btw, here is a link to the PA Uniform Firearms Act.

http://www.frontlinearmory.com/misc/paoc/ufa.html

this is the state law on firearms. of note is the fact that there is no mention of hollowpoints, no mention of magazine capacities, and there is a preemption clause that prevents philly from enfocing their own gun laws (though the morons on their city coucil keep passing them anyway):

Quote:
6120. Limitation on the regulation of firearms and ammunition.

(a) General rule.--No county, municipality or township may
in any manner regulate the lawful ownership, possession,
transfer or transportation of firearms, ammunition or ammunition
components when carried or transported for purposes not
prohibited by the laws of this Commonwealth.

Never ask a law enforcement officer a question about the legality of anything firearm related. If they happen to be one who does actually have a grasp on the UFA, they almost certainly learned it from this forum, or from a lawsuit filed against them.
Here is the only reference to ammunition legality, that I know of. It states that these types of ammunition are illegal to have or use during the commission of a crime of violence. In other words, you can use and possess even these types of bullets, as long as you are not committing a crime of violence.

6121. Certain bullets prohibited.
(a) Offense defined.--It is unlawful for any person to
possess, use or attempt to use a KTW teflon-coated bullet or
other armor-piercing ammunition while committing or attempting
to commit a crime of violence as defined in section 6102
(relating to definitions).
(b) Grading.--An offense under this section constitutes a
felony of the third degree.
(c) Sentencing.--Any person who is convicted in any court of
this Commonwealth of a crime of violence and who uses or
carries, in the commission of that crime, a firearm loaded with
KTW ammunition or any person who violates this section shall, in
addition to the punishment provided for the commission of the
crime, be sentenced to a term of imprisonment for not less than
five years. Notwithstanding any other provision of law, the
court shall not suspend the sentence of any person convicted of
a crime subject to this subsection nor place him on probation
nor shall the term of imprisonment run concurrently with any
other term of imprisonment including that imposed for the crime
in which the KTW ammunition was being used or carried. No person
sentenced under this subsection shall be eligible for parole.
(d) Definition.--As used in this section the term "armor-
piercing ammunition" means ammunition which, when or if fired
from any firearm as defined in section 6102 that is used or
attempted to be used in violation of subsection (a) under the
test procedure of the National Institute of Law Enforcement and
Criminal Justice Standard for the Ballistics Resistance of
Police Body Armor promulgated December 1978, is determined to be
capable of penetrating bullet-resistant apparel or body armor
meeting the requirements of Type IIA of Standard NILECJ-STD-
0101.01 as formulated by the United States Department of Justice
and published in December of 1978.
(Dec. 21, 1984, P.L.1210, No.230, eff. imd.)

1984 Amendment. Act 230 added section 6121.
