As long as you have a LTCF you are fine.

Yep, there's already at least two threads on the subject. I couldn't find them but I didn't look too hard either.

Yep, it's legal. Carry on.

I've seen this question asked a few times and can't recall a definitive answer as to whether or not you can without a LTCF.

With that in mind I fired this off to the Pa AG:

Quote:
Good Day,

It is my understanding that since there are no laws against openly carrying (OC) a hand gun in Pennsylvania, that OC is legal to do in Pennsylvania without a License To Carry Firearms (LTCF), except in cities of the first class (Philadelphia).

It is also my understanding that to carry a loaded hand gun in a vehicle a LTCF is required.

My question is; Can you OC on a motorcycle without a LTCF (except in cities of the first class) since you are technically not in a motorcycle but rather openly on a motorcycle?

Thank you for your time,

Bill xxxxxxxx
I'll let ya know if/when I get a response.

Bill

It's transporting by vehicle so you would need a LTCF.

I wouldn't because if you crash your gun is going to get all messed up.

The actual condition (per the UFA) requiring a LTCF is "carry in a vehicle". This then leads to the debate of "carry" vs. "transport" as well as "in" a vehicle vs. "on" a motorcycle.

"Transporting", is not specifically addressed in the UFA, at least as it relates to moving from place to place while in possession of a firearm (outside of the specifically enumerated exceptions).

The flipside is:

If a LTCF required for in vehicle carry as it is considered concealed and if motorcycle carry is considered as being in a vehicle (LTCF always needed), then even if you OC on motorcycle it is considered concealed so even an anti OC LEO should not stop you. Though I am sure they would anyway.

I think the ruling would be that it is 'in a vehicle' as they would not want any transport to be easily done without a LTCF. The nefarious rulings of government and all.

I've often joked with my friend who lives in Beaver Falls that I was going to drive a motorcycle from Warren to Beaver Falls with my AR across my back. This would entail a long drive across I-80 and then down I-79, so I'm sure I'd get a few calls placed about my ride... lol

I then began to wonder about the legality of that scenario... any thoughts?

Exactly, no definitive answer in both Fed & state regs either way, hence my note to the AG.

If you have a LTCF you're covered no matter what (handgun) I'm curious about no LTCF.
