Default Re: Heller Decision to be released as late as Monday 6/23?

For Heller fans, the correct count for March is that two cases remain -- Rothgery (involving the right to counsel) and Heller -- and Justices Scalia and Souter have not yet written in that sitting.

The next opinion day is Monday. There will certainly be one or possibly two additional opinion days next week. Wednesday and Thursday are most likely.

Default Interesting SCOTUS split

One case today had an interesting split, Kentucky v. EEOC. The case concerned interpretation of a statute passed by Congress, the Age Discrimination in Employment Act of 1967.

Majority in Kentucky v. EEOC:
  • Breyer ("liberal"),
  • Stevens ("liberal"),
  • Souter ("liberal"),
  • Roberts ("conservative"),
  • Thomas ("conservative")

Dissent in Kentucky v. EEOC:
  • Ginsburg ("liberal"),
  • Kennedy ("moderate"),
  • Scalia ("conservative"),
  • Alito ("conservative").

The media often portrays the Supreme Court Justices as being "conservative" ("right-leaning") or "liberal" ("left-leaning") in their judicial opinions. And unfortunately the Justices are sometimes unduly swayed by their own political leanings. (And some Justices seem more afflicted by this than others...) But occasionally the Justices differ in judicial opinion along lines other than the traditional "liberal"/"conservative" division.

I hope the supreme court decides in our favor and hopefully someday and we can own fully automatic weapons again at fair prices ... I really want to buy a real m-16 and not have to take out a huge loan to get one... i love that three shot burst thing at the range. plus that aa-12 automatic shotgun would be fun to shoot at the range... a waste of money? yeah... but i'll try anything legal once.

i mean if it voids the dc handgun ban, why not the full auto ban? why not the semi auto bans in cali and nj? why not equal firearms for government and civilians?

Dont get your hopes up that high. The MG ban isn't at the heart of the challenge - only complete bans on possession and bearing.

If/when they rule it an individual right - it wont undo all the laws around the country. It'd only fix the DC laws directly and provide precedence to challenge other laws elsewhere in other lawsuits.
