PITTSBURGH -- A home invasion suspect was shot after a house in the 3100 block of Josephine Street was broken into on Pittsburgh's South Side late Wednesday night. According to police, Dale Boehm, 19, and another man broke into the home through the kitchen while a resident there was watching the Penguins game. Police said a 25-year-old resident of the home heard the door being kicked in, so he grabbed a gun and began exchanging fire with Boehm and another man. Boehm was shot in the stomach, police said. He was taken to UPMC Mercy Hospital in critical condition. "We heard some sounds that thought were fireworks for the Penguins game, but it wasn't," said neighbor Josh Ebaugh, who said he realized it was gunfire when police showed up. Police were unable to locate the other man involved in the home invasion. They recovered a baseball bat and firearm at the scene. Attorney John Elash, who has tried 150 homicide cases in the last 33 years, knows a bit about self-defense with deadly force. In 1981, Elash won an acquittal for Carrol Jones who shot two unarmed home invaders, killing one. "They didn't have a gun or knife on them, but they were coming at him," Elash said. "In your own home, you don't have to retreat. You don't have to back up. You don't have to run into another room. You can protect yourself right there, and you can use deadly force. "The man who shot the intruder said he is packing his belongings and moving out of the home.Boehm is charged with burglary, robbery and aggravated assault, among other charges. Police said he would be taken to Allegheny County Jail once he is released from the hospital.

Glad to hear the would be victim was armed and defended the life. It is rare to hear this type of thing turn out well.
As for the keep shooting him thing...well that may make be ok in the keyboard commando situation I am glad he defended his life without catching the baggage that often comes with killing another person....Or criminal charges by an over excited DA that might not like people defending themselves.... -A

Emptying a mag, no. But a double-tap wouldn't be unreasonable.
Though from the sound of how it was written, I doubt he had the luxury of that. |

These incidents, mostly police at the scene, would still hold as valid examples in court. Most police officers and defense trainers I've been speaking to say what I specified above. You never know when the person is a crack addict. Their sensory to pain is pretty much disabled, they'll just keep on coming at you even if you shoot them three times to the chest. Though, I guess crack addicts where not the case here, you never do know. I must add, I took a CCW course a couple weeks ago which is required for me to obtain my Alaska CCW permit. Affirmative. I'll be going to Pittsburgh on the 20th of June, so I need to get my CCW if I'm going to carry my firearm around with me since I'll also be in vehicles.

Hey EM, thanks for posting this here for those of us who do not necessarily frequent the 'Press Releases' thread.
I'm glad that the mods are not super strict regarding this, as I barely have enough time to keep up to date with the 'general,' 'Q&A' and 'Concealed and Open Carry' based threads. This is one of the topics that is clearly important enough to be made, 'General.' It seems that the situation regarded in the article of the OP is one of the many cases that promotes the value of making use of every tool and opportunity to defend oneself. I bet that the last thing most of us are doing when we sit down to watch the game is to prepare against a home invasion. It can happen any place at any time. This is a good lesson to all of us... Be prepared! |
