Default Re: NRA files suit for restraining order on Nutty Nutter and illegal Philly laws

Looks like the attorney is quite a pistol:
"I'd advise every resident of Philadelphia to go out and buy their guns now," Shields said, adding that Nutter had made uncertain the future of gun ownership in the city.

Shields praised District Attorney Lynne M. Abraham's announcement Tuesday that she would not enforce the new gun laws because such prosecutions would violate Supreme Court precedent. He called on Abraham to prosecute Nutter and Council members for "official oppression," a charge usually made against police in brutality cases.

"I am not going to arrest the mayor and members of City Council," Abraham said in a statement yesterday.
He's definitely got a pair

The petition says a lot, and also accomplishes nothing. There are no provisions in Pennsylvania state law to remove an elected official by petition or impeachment. According to the Pennsylvania Supreme Court, the only way to remove an elected official, even Mayor Nutter, is by court action following a conviction for crimes so listed in the state constitution, or by the registered electors via ballot. His misdemeanor offenses, odious as they are, do not rise to the level of a removable offense.

This I know, but what the petition does show. Is that law abiding citizens will no longer sit back and do nothing. I for one will be at ALL court hearings regarding the matter. I will no longer sit back and let the elected offices do as they please. If I am to follow ALL laws, so are they. And this does not stop at Mayor Nutter. I am sick of elected officials and big corporations! And how they feel they are above the laws!! Greed and corruption run the world, how would you like to see these 2 things be removed from it all?

Actually you could label his actions as treason which is indeed a prosecutable offense. If I recall correctly, that's even punishable by death.

I think only in times of war now. Which, last time we declared war was June 1942, and ended in late 1945.

Why don't some philly residents file suit and charges on mayor nutty. Misappropriation of government funds. It's rather obvious the mayor's action are not within the law. His effort is a non starter. he knows this. We can only conclude his is doing it as a publicity stunt to further his political career thus he is using public funds for campaigning. I suppose the suit wouldn't get very far but it would cause him to use his own money to defend himself. Get enough residents together and the cost per person would be minimal. Heck, I would kick in a few. Maybe extend the suit to the whole consul

Hi- Hey, can you help me with a link to this information? I have an unrelated situation where an elected official is being removed from office. Before I'm forced to disrupt the next council meeting in defense of the constitution, I'd like to know exactly where this matter stands.

My need is urgent, and I appreciate your help.

If this is happening in a borough, then contact Ms. Shelley Houk at shouk@boroughs.org. PSAB is the Pennsylvania State Association of Boroughs, and Ms. Houk is the person with all the answers. If it's a township, then you want to contact the Pennsylvania State Association of Township Supervisors at psatsweb@psats.org.

See also Article 2, Section 7 of the Pennsylvania State Constitution and this link: http://rds.yahoo.com/_ylt=A0geu9z59j....aspx/%3fid=39

Basically, absent a court conviction, an elected official once sworn in can stay in until the next election, even if that person never once attends a borough/township meeting.
