Default Beer and guns

Lets say I'm at home enjoying a few beers and someone breaks in armed. Would I be justified in shooting them in this case? Even if it was a total act of self defense? What would the police say when they showed up if I had an odor of beer on my breath? Even though I'm in my own home, could I get in trouble for somehow mixing beer and guns?

You are allowed to sit in your house and drink beer and get drunk. If someone breaks in and you shoot them in self defense, it is sort of irrelevant whether you are drunk or sober. If you miss the guy and send a bullet down the road into your neighbor's back, then you could be sued and the booze could become a factor. But that is an issue for lawyers - you can be sued for just about anything.

As long as the cops determine that the shooting was justified and you were acting in self defense, then the alcohol shouldn't come into play.

The only role that alcohol could play was, did it affect your perception of what happened or what you are claiming to have happened. This would come to light in a questionable shoot as opposed to sitting on your sofa watching Seinfeld and someone breaks in.

The above is a general statement, as each shooting is a unique event.

I think if you are kicking back a few beers on your couch then you are in a fairly mellow mood. Therefore, the perp would have had the best chance not to be shot. Unfortunately, for the perp, he made a poor decision that caused the end of his life. It's not your fault that he made the choice to enter your dwelling uninvited. Now go get some joint compound and paint and fix the wall.
