haha damn, Mercer County Sheriff's deputies had a bad habit of serving my neighbor's legal papers at my door for a while. good thing SWAT was never needed.

Same with XD45's case, the constable reached in person the named subject on the papers. Anyone else in the store is of no concern to the constable. So why should the constable ask for XD's name?? it is irrelivant to the papers, hes not obstructing justice. The constable has no right looking around the building AT ALL without a warrant. I can understand if he's standing there looking around where customers are allowed. BUT what on earth would make him think he can just nose around behind the counter?? whats back there again has NOTHING to do with serving the papers.

So in both case's can anything of legal action be taken against someone for not providing their name?? Or in XD's case can tresspass/harrasment charges be charged against the constable??

I luckly have never had to deal with any of these issues. But just want to know what are my rights .

Just like the po-po, what they are ALLOWED to get away with they can. Once they start overstepping their boundaries threaten to call the police and see how quickly most will change their tune. They have limited arrest powers within the boundaries of their warrants and events they witness, i.e. if they see you robbing someone, they can arrest you. They have ARREST warrants and civil judgement papers that they can serve. They have ZERO right to search someplace EXCEPT to look for the named person on the warrant. They can't come into your house/business and after they find the named person on the warrant say they are gonna look around. FOR WHAT...the only thing they are authorized to find, they already found. I have only had 1 run in with a constable, I was at home and I heard someone jiggling my screen door on my patio door (apartment has a cement pad outside a sliding glass door) with my pistol in my hip holster I walk out into that room and ask if I can help him, (thumb break broken, hand on pistol butt, knowing that the screen door was locked like always) he shows me his little shiny badge around his neck and asks if I know (insert name here) I said no. He said "oh it lists their address as 603" I tell him, "Well this is 604 and I point toward the patio door of 603" He ask if he can come through my place to go knock on their inside door and I told him No you can't. He started to give me all kinda nonsense about cooperating with law enforcement, I asked him " Do you have a warrant there with my name on it?" He asks my name, I laughed and said have a nice day, and if you pull on my screen door again I will have you arrested.

Not doubting or saying your wrong but it would be great if you had some sort of cite to that. I've never heard that before...

I read somewhere they do get paid $$ to serve court papers. Not sure of the amount I think $25-50 a pop.

Its a nice part-time gig for some I'd suppose. If you don't mind possibly getting shot at in the 'wrong' part of town being 'mistaken' for LEO. Great when 'backup' is on your CELLPHONE just like us 'common-folk'. haha.

Wondering...what type of photo-card I.D. are constables issued? Is it from the state or from their county...surely they have a card to go with the badge to I.D. themselves and we have a right to ask for it and make sure they are a constable. Anyone can get a badge made up. And well, I guess anyone can make up an I.D. card too. Do they all carry a standardized I.D. I guess is the better question.

that must be why the try to serve the papers after midnight. "geez i tried to serve the pappers 37 times, they never answered the door". LOL

I have encountered them professionally DOZENS of times. Have never seen one that was not in full regalia when serving (process). Some a little much for my taste (think Tactical). One was shot at through he door about a year ago, an old timer, when I saw him next all he said was "glad she used birdshot".

As far as using cell phones, in Lycoming Co the Constables have radios that are on a County Communication Freq. and they can talk across the bands.

Also, most of the Constables here are Full Time. Seem to do alright, living wise I mean.
