Question about a ftf transfer to an out of state person

I have a gun for sale on this and a few other forums. I had someone express interest in the gun and wanted to purchase the gun ftf. The buyer is an out of state resident. He wanted his brother who is a PA resident to meet me for the transfer and then he would get the gun from his brother. I am not 100% sure but I think that is illegal and would be considered a straw pruchase. Am I correct in that thinking? I also thought that siblings could not "gift" firearms to each other.

Gifting of guns varies by state. As for a "straw purchase," you can only be held responsible if you have evidence or knowledge of the illegal intent of the person you are selling the gun to and the DA can prove this beyond a reasonable doubt.

I would not get involved in such a deal personally.

Ship the firearm to the purchaser's FFL in their state of residence.

Technically if the firearm is a long gun you could give it to the brother, take the cash, be on your way and what the brothers do is between them. However the buyer is going to have to get it via an FFL whether it's from you or his brother so I can't see why he'd want to do it that way unless I am missing something.

There's plenty of buyers for guns, avoid shady people.

If you know that the actual buyer is from out of state and the "brother" picks it up to get it to the buyer - then essentially its a "Straw Purchase" act.

There is some seriously bad mojo with that situation and its best to steer clear of it. For all you know it could be a BATF-E sting in operation to fight interstate trafficking of firearms.


Now if the buyer is the instate "brother" and he buys it off of you, then theres no problem. ...what he does with it after the fact is his own doing. HOWEVER, GET A RECEIPT FROM THE BROTHER!!!

If the firearm is a handgun, then no matter who it goes to - it must go threw a FFL.

WOW idiots at best...good call on staying away from them. Good luck finding a real non idiot purchaser..

Follow your gut instinct. I think everyone here realizes this sounds borderline sketchy.

Part of being a responsible gun owner is knowing when to walk away from questionable situations in all areas of our hobby.

Nothing "iffy" or "boarderline" about it. It's a straw purchase the way the buyer explained it and is prohibited.
