I really but really wonder about the posts some of you guys write here.

You have the right to keep silent, if you are this dumb, it becomes an obligation, the words you write here will come back and bight you in the ass some day. You don’t really believe no one will research every thing you said, did and wrote if you are some day up for murder charges do you? Even if it is self defense, I always say to people, your “MINDSET” will show intent if you wind up in court.

If you said it on a public board such as this, and the lawyer brings it to court, you are 100% screwed, even if you did nothing, the mere fact you once suggested it was a good idea will be used against you!

First off, you just shot some one, you wont know what to do even if you are a lawyer, to say here what to do and actualy do it when you are on the scene is 2 things.

When you pick up your gun and put it on your belt, remember one thing, if you shoot at some one, you become mute until you see your lawyer. To say you where scared, it was self defense; you will babble and make no sense at all. Say the minimum, your name, info to identify you, ask for a lawyer.

Don’t even carry a lawyers card on your unless you deal with firearms on a regular basis an need it with you all the time, if you have a lawyer on retainer, know where to get a hold of him, ask for a phone book, but say nothing and keep nothing on you to say you had “Intent”.
As for first aid: Nothing you do will help you once you hit the BG, saving him may look like a good thing, remember you will be in shock, you may well harm him more then help, stay away, keep your safe distance, be aware of the surroundings, wait for the police.
You might think you “called” 911, but by the time you actually do, it will be called in already unless you are some were that no one head the shot(s).

To say you would “plant” a gun on this person implies you would have an illegal gun on you. Right there, I question what you believe you could say to your peers here about this.
We are fighting laws that try to prevent us from buying guns, and there you go saying you have an illegal gun on you to “plant” on some one if you need it.

I deal with the police every day, what I say to them is listened to, what I repeat to them has to be 100% correct, what I do/don’t say to them can be used against me if I go to court. I am drilled in this regularly, I am responsible for the info I give them or keep from them, and when a police calls back to question the info I related to them, first thing I do is transfer the call to a supervisor.
The quicker you can divert the police to some other source the better you are off. Not that they are the enemy, but just that in the heat of the moment, you are bound to say the wrong thing.

The best other source you have, is a lawyer and silence. Expect to do therapy after, even the police who are trained and are expected to shoot when needed, this is the first that is suggested to them, public shootings are the same, every one involved, in the same area is asked to meet with a therapist.

Right after the shooting, if you can remember to do this, note down information that may be needed, time, date, conditions, (snowing, raining, dark, crowd) try to get witness names plate numbers, descriptions of people who where there who might help you in your defense. Shooting happened in your home, you are alone, go to a neighbor, have them call the pd for you, ask them to call a friend or relative for you, do not say anything to them other then you need help. Do not go away from the scene other then to get help. Return to the scene as soon as the police are there, identify yourself, and stay quiet. Give them the info you where able to gather. Nothing more, they know you shot the person, why you did it is not their concern at this time, the first police on the scene are no the investigators, they are not the detectives; they are the main police you see in uniform. They are not there to judge you, but will if you allow them to, so the less you say, the better you are. The fact that you are in shock means nothing to them, if they are really your friends, they will take you away and tell you to wait to see a lawyer.


and stay away from cliche sentences like I pleed the 5th, this is only usefull in court, just say you wish to see a lawyer, nothing more, they have to respect this.

As far as seeing a Therapist or your Doctor for any counseling, be sure that they can be trusted. A report from them to the authorities and your guns are gone.

I really liked Frenchy's post except his bash on RonPaul08. It's obvious that guy was joking, a little humor goes a long way in my opinion in such a serious conversation. By nature I am not a serious person and I know this is a very serious topic, but I appreciate a joke now and then to lighten the mood.

All in all I have read some very good advice in this thread I hope I can retain if the day ever comes and this happens to me.

A therapist cannot report anything you did in the past. You can tell them that you killed your wife, and even where she is buried, and they can't say anything. However, if you say you're GOING to kill her and bury her under the tomato plants, they have to report it.

You also cannot be 302'ed for something you did in your past, justified or not... All that they care about is your future intentions...

IIRC, Moosad Adabooboo(you know the firearms expert/cop that writes for multi- gun mags and Backwoods Home) has suggested that if you do make the 911 call state that there has been a shooting and that you need an ambulance and the Police- in that order. Then on "Guns and Ammo TV" he said that when the Police arrive I.D. yourself as the one who called and that you will sign a complaint against the "Actor".... say you want to co-operate fully, show your I.D.,then ask to speak to your mouth piece, then shut-up-period.
I hope I never have to make such a call.
