Default Student Arrested After Showing Up to School in Body Armor

http://www.foxnews.com/story/0,2933,302557,00.html

An 18-year-old Florida student was arrested Monday after officials informed police he was wearing a bullet-proof vest on school property.

Shawn Keiffer Newberry, 18, of Lakeland, Fla., is facing charges of armed trespassing, grand theft and criminal mischief after police found the student had purchased body armor, a Taser, AK-47s, a shotgun, gas mask and ammunition among other items, officials said.

A search warrant executed on the student's home found a video showing Newberry and four others using the AK-47s for target practice.

Officials notified police Monday that Newberry was wearing a bullet-proof vest at the Life Skills Center in Lakeland. Newberry, officials said, was evasive when asked about the vest and a search of his vehicle turned up "Clear Out," a chemical agent used to temporarily incapacitate a person.

Sounds like he is taking advice of the Boy Scouts and "Be Prepared" with a nice Bug Out Bag.

But if he is of legal age, he can legally buy those items. Not sure on the vest though. Is a bulletproof vest legal to purchase and own?

Last time i check you can buy body armor and ballistic plates (Police issue plates not mil-spec) at least in this state.

Wonder how fast these charges are going to get dropped. How do you get charged with armed tresspassing by wearing a bullet proof vest? I guess all the cops are guilty of it too! Not only that grand theft for what legally purchasing firearms, body armor, etc? Hell at the last gun show in Harrisburg someone was selling CS grenades!

Yeah, I don't know why, but I thought owning bulletproof body armor was illegal. Or had to have NFA C3 for it or something. I don't know. I am sure someone will correct me. But that is how I learn.

I will also be following this thread to learn. I had the impression for some reason that body armor was illegal but that probably came from TV or movies. Looking forward to hearing from the informed.

Here's a few other news stories (I just googled "Shawn Keiffer"):

Teen wears bullet proof vest to school

Lakeland, Florida - Police have uncovered a stash of weapons after arresting a student at the Life Skills Center, an alternative high school on East Memorial Boulevard in Lakeland.

Officials at the school called police on Sunday when 18 year old Shawn Keiffer Newberry wore a bullet proof vest onto school property. Officers also found a chemical spray in his car.

Police later searched Newberry's home and found body armor, three AK 47's, a shotgun, a taser, chemical grenades, and a gas mask. Officers also found a video recorder with images of Newberry and three other people engaged in target practice with the AK's.

The video also shows the teens firing on a Lakeland Ledger newspaper rack and detonating what police say is an explosive device of Winter Lake Road in Polk County.

Lakeland police are not saying if there were any kind of threats made against the school or students.

Police have charged Newberry with armed trespassing, grand theft and criminal mischief.

Student Who Wore Armor to School Arrested

A Lakeland police officer questioned Shawn Keiffer Newberry, 18, about the vest on Oct. 3 at the Life Skills Center, 407 E. Memorial Blvd. When he didn't answer, a search of his vehicle turned up a can of Clear Out, a nonlethal tear gas-like spray.

During an interview with police, Newberry talked about tactical methods to defeat body armor, stating he trains every weekend using at least 1,000 rounds of ammunition, according to Sgt. Terri Smith.

Further investigation revealed Newberry has purchased body armor, a Taser, three AK-47s, a shotgun, Clear Out grenades with tubes for under-door deployment, a tactical helmet, a gas mask and about 2,000 rounds of ammunition since January.

Newberry's father, Mark McNeill, had turned over to Lakeland police firearms that belonged to Newberry.

At Newberry's home, 2108 Selkirk Lane N., police found many rounds of ammunition of various calibers and a video camera with images of Newberry, three other young men and a woman who appear to be doing target practice with AK-47s, according to Smith.

During one practice session, the target is a Ledger newspaper box. The video also shows the detonation of an explosive device, which was determined to have happened just off Winter Lake Road in south Lakeland, Smith said.

The State Attorney's Office has charged Newberry with armed trespassing, grand theft and criminal mischief.

You beat me to posting that by a minute. And after reading those, I don't see what crimes were committed. If a vest is legal to own, is it illegal to wear it to school? Is it illegal for an 18 yr old (adult) to buy a shotgun? Is it illegal for him to buy an AK47? Can he not buy ammo and stock pile it? Is he not allowed by law to target shoot? And video tape it?

Either we are missing some info here, or someone charged this kid without a crime being committed.

I believe its illegal to wear in the commission of a crime. (Shootout in CA.) Otherwise body armor and ballistic plates are legal to own AFAIK. You wouldnt beable to buy it on the internet if it was a national law. Hell it would be restricted but you can buy it if you so chose too.
