				<b>Court: Criminal Record May Not Prevent Gun Ownership</b><br />

A federal appeals court has overturned the conviction of a Wisconsin man barred from owning firearms because of his criminal record, ruling the lifetime prohibition may violate Americans' Second Amendment rights and calling into question the future of a 13-year old gun control law.<br />
<br />
In a 3-0 decision on Wednesday, the Seventh Circuit Court of Appeals ordered a trial judge to take a second look at the evidence that a 1996 federal law prohibiting anyone convicted of a &quot;misdemeanor crime of domestic violence&quot; is constitutional in light of a U.S. Supreme Court ruling last year that emphasized &quot;the individual right to possess and carry weapons.&quot;<br />
<br />
This case involves a man named Steven Skoien, who previously had been convicted of misdemeanor domestic battery. A year later, a Winchester 12-gauge hunting shotgun was discovered in a truck parked outside his home, along with evidence (including an orange hunting jacket, a deer carcass, and a state-issued tag for a deer kill) that he had used it earlier in the day. He was charged with illegal possession of a firearm.<br />
<br />
This is a notable -- even remarkable -- appellate opinion for a few reasons. First, it shows that U.S. Justice Department has become a bit lazy in prosecuting gun cases: the court noted that &quot;the government has made little effort to discharge its burden of demonstrating&quot; the constitutionality of the law, and &quot;relied almost entirely on conclusory reasoning by analogy.&quot;<br />
<br />
Second, and more importantly, this is one of the first appeals court cases to take an in-depth look at the impact of the Supreme Court's ruling last year in D.C. v. Heller on existing federal firearms laws. It's true that Justice Antonin Scalia's majority opinion said: &quot;Although we do not undertake an exhaustive historical analysis today of the full scope of the Second Amendment, nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill...&quot;<br />
<br />
But misdemeanors are different from felonies, which the Seventh Circuit noted: &quot;We therefore assume that Skoien's Second Amendment rights are intact notwithstanding his misdemeanor domestic-violence conviction.&quot; The judges said that the ownership ban is life-long and sweeping, providing no way for a now-peaceable citizen to seek an exception: &quot;The government has the burden of establishing a reasonable fit between its important interest in reducing domestic gun violence and the means chosen to advance that interest -- Section 922(g)(9)'s total disarmament of domestic-violence misdemeanants.&quot; (What they didn't point out, but could have, is that a law enacted in 1996 is not exactly &quot;longstanding.&quot;)<br />
<br />
The Seventh Circuit opinion, which now has shifted the burden of proof to the Justice Department through an &quot;intermediate scrutiny&quot; standard, was written by Diane Sykes, a George W. Bush appointee, and joined by William Bauer, a Ford appointee, and John Tinder, a George W. Bush appointee.<br />
<br />
A review of cases since the Heller decision shows that nearly all judges have been content to say that it means that the federal law, 18 U.S.C. 922(g)(9), is perfectly acceptable. Here are excerpts from opinions written by other judges, usually trial judges, who rarely engaged in a complete analysis of the Second Amendment and instead typically assumed 922(g)(9) was perfectly constitutional:<br />
<br />
U.S. v. Holbrook: &quot;Thus, the Heller opinion itself does not 'cast doubt' on the limitation on firearm possession set forth in Section 922(g)(9), and Holbrook makes no other argument that her convictions are violative of the Second Amendment.&quot;<br />
<br />
U.S. v. Montalvo: &quot;Defendant has not cited any post-Heller decisions declaring 18 U.S.C. 922(g)(8) to be unconstitutional, and does not attempt to distinguish the post- Heller cases cited by the government. This is not surprising, since 'it appears that every court which has considered a Second Amendment challenge to 18 U.S.C. Section 922, post-Heller, has upheld the statute as constitutional.'&quot;<br />
<br />
People v. Marsh: &quot;We conclude that (a similar section of California law) falls within this category of prohibitions which are permitted despite the right to bear arms afforded by the Second Amendment. Post-Heller decisions addressing the constitutionality of various firearm possession restrictions have taken a similar approach...&quot;<br />
<br />
U.S. v. Luedtke: &quot;Nothing in Heller suggests that the court intended to permit only those precise regulations accepted at the founding. Rather, the court's examples are best understood as representing the types of regulations that pass constitutional muster... Sections 922(g)(8) and (9) are regulations of a type traditionally permitted in this nation...&quot;<br />
<br />
U.S. v. Li: &quot;I am satisfied that the provisions of section 922(g)(9) pass constitutional muster, even in the wake of Heller. Li has not offered any persuasive reason to believe that post-Heller constitutional jurisprudence should render it otherwise.&quot;<br />
<br />
U.S. v. Chester: &quot;The court finds that the prohibition by Congress as embodied in Section 922(g)(9) of the possession of a firearm by a misdemeanant who has committed a crime of domestic violence is a lawful exercise by the government of its regulatory authority notwithstanding the Second Amendment.&quot;<br />
<br />
U.S. v. Engstrum: &quot;While it is troubling to the court that Section 922(g)(9) may be used to deprive otherwise law-abiding citizens, who pose no prospective risk of violence, of their Second Amendment rights as a result of a single past transgression, the court cannot say, as a matter of law, that defendant poses no prospective risk of violence, and that he is constitutionally entitled to an exception to Section 922(g)(9).&quot;<br />
<br />
U.S. v. Robinson: &quot;To my knowledge, no court has, even under an individual rights interpretation of the Second Amendment, found 18 U.S.C. Section 922(g) constitutionally suspect.&quot;<br />
<br />
U.S. v. White: &quot;On its face, then, Heller did not disturb or implicate the constitutionality of Section 922(g), and was not intended to open the door to a raft of Second Amendment challenges to Section 922(g) convictions. White's Motion to Dismiss would place far more weight on the Heller decision than its plain text can reasonably bear.&quot;<br />
<br />
In re: United States of America (U.S. v. Engstrum): &quot;Nothing suggests that the Heller dictum, which we must follow, is not inclusive of Section 922(g)(9) involving those convicted of misdemeanor domestic violence.&quot;<br />
<br />
<br />
The last case came from the Tenth Circuit Court of Appeals, which was a 2-1 decision that I wrote about in August. The dissent, from Judge Michael Murphy, is more interesting. It says: &quot;There is simply no authority for the government's assertion that Section 922(g)(9) is constitutional in light of Heller... I would grant a stay of the proceedings below and order further briefing on the constitutional question.&quot;<br />
<br />
The constitutional question is more open than many CBSNews.com readers might suspect. C. Kevin Marshall, a former Bush Justice Department attorney who's of counsel to Jones Day in Washington, D.C., wrote a law review article earlier this year titled &quot;Why Can't Martha Stewart Have a Gun?&quot;<br />
<br />
Its surprising conclusion: federal law's lifetime prohibition on non-violent felons possessing firearms is relatively recent and probably not consistent with the views of the Second Amendment's framers. In an age when Americans can be non-violent felons for possession of a short lobster or sharing MP3 files (other examples here), is a lifetime ban constitutional?<br />
<br />
For other constitutional rights such as the First Amendment, it's relatively common to see acts of Congress struck down as going too far, as anyone who's followed the series of cases about Internet pornography or abortion can attest.<br />
<br />
That hasn't been the situation with the Second Amendment even after the Heller decision, in part because some judges have not taken constitutional arguments seriously, and in part because the Supreme Court has not provided a road map to follow. The justices now have a chance to remedy that oversight in the case currently before the court, McDonald v. Chicago. If they don't, expect this constitutional confusion to continue.

COLUMBIA, S.C. (AP) -- South Carolina shoppers will get a second chance to buy tax-free guns.<br />
<br />
The state Revenue Department sent out a reminder Wednesday of the upcoming &quot;Second Amendment Weekend.&quot; The 48-hour tax break begins just after midnight the Friday after Thanksgiving.<br />
<br />
Shoppers will pay no state or local sales taxes on handguns, rifles and shotguns, which can total 9 percent. Taxes still apply to ammunition and accessories.<br />
<br />
South Carolina had the nation's only tax holiday on guns last year. Legislators tacked it on to a tax break on energy-efficient appliances, then restored it in the budget this year.<br />
<br />
Louisiana followed with a sales tax holiday for hunters in September. That break went further, applying to any item that can be used for hunting or fishing.</div>

Police say a clerk at a Wilmington liquor store shot and killed a robber, but his two accomplices are at large.<br />
<br />
Police say three masked men told the 55-year-old clerk at Favors Liquor Store that he was being robbed at about 9:30 p.m. Tuesday. When two of them pulled guns and ordered the clerk to the back of the store, he exchanged fire with them.<br />
<br />
At least one of the men was hit. He staggered outside and collapsed on the sidewalk and was pronounced dead later at Christiana Hospital.</div>

An armed suspected was shot in Delaware County after attempting to rob an undercover detective posing as a pizza deliveryman Wednesday night.<br />
<br />
Verona Pizza on W. Chester Pike in Upper Darby contacted police after receiving a suspicious delivery order at about 11 p.m.<br />
<br />
Delivery drivers at the business have been held up at least three times in recent weeks. <br />
<br />
An undercover detective stood in as a decoy, making the delivery near Delaware and South Harwood Avenues. Once at the address, a masked suspect armed with a gun jumped out from the bushes and rushed towards the officer. <br />
<br />
Despite a warning, the suspect continued to rush forwards, forcing the detective to fire once shot which struck the suspect in the torso.<br />
<br />
The wounded suspect was taken to the Hospital of the University of Pennsylvania in serious, but stable condition. The detective was not injured in the incident.<br />
<br />
Following the shooting, police began pursuit of an apparent getaway vehicle. One female suspect was apprehended as she attempted to flee the vehicle. A second male suspect is still on the loose.<br />
<br />
The incident remains under investigation.</div>

SUNNYVALLE, Calif. -- For the past six months, 27-year-old David Julian has been walking around Sunnyvale and Cupertino carrying an unloaded Beretta 92 FS strapped to his leg. He is part of a national movement known as &quot;open carry.&quot;<br />
<br />
Julian and others say they're just exercising a constitutional 2nd Amendment right to bear arms.<br />
<br />
&quot;I think that if more people carried, you'd have a reduction in crime and I think that's an all around good thing,&quot; said Julian.<br />
<br />
Advocates of &quot;open carry&quot; meet in public places such as this Cupertino Starbucks. When KTVU was there with a group, no one seemed to notice or care.<br />
<br />
Even a police officer driving by failed to see the group drinking coffee outside with their weapons in plain sight.<br />
<br />
Greg Harvey joined the movement two months ago and now carries his Glock 22 at his side at all times.<br />
<br />
&quot;There's a little sense of security. That's probably more why I do it and it's my right,&quot; said Greg Harvey.<br />
<br />
In California, you can do it as long as the gun is in plain sight unloaded and in a holster.<br />
<br />
&quot;A person does have the legal right to carry a weapon; a firearm displayed openly on their person in a public place. Now we have to keep in mind that the weapon cannot be loaded and the ammunition cannot be attached to a gun in any way,&quot; explained Sunnyvale Police Capt. Doug Moretto.<br />
<br />
But California law does allow bullets to be close at hand.<br />
<br />
&quot;Anytime a firearm is involved in a incident, the potential for that incident to escalate is there,&quot; cautioned Capt. Moretto.<br />
<br />
David Julian said he carries more than a gun and ammo to protect his rights. &quot;I also carry a video recorder in the form of an iPod so if I have to take video or something, I can do that.&quot;<br />
<br />
In 1967, the Black Panthers showed up at the state legislature in Sacramento carrying loaded weapons. The legislature soon changed the law in response to limit open carrying to unloaded weapons.<br />
<br />
The question of whether the openly carried weapons are loaded remains a serious issue for California law enforcement.<br />
<br />
&quot;Who's to say if that gun is actually loaded?&quot; asked Santa Clara County Sheriff's Department Sgt. Rick Sung. &quot;We don't know. That's why the officer is constantly making contact with these individuals.&quot;<br />
<br />
At an appearance by President Obama in Phoenix this past summer, open carry advocates showed up with automatic weapons.<br />
<br />
&quot;How do we protect the public and ourselves in dealing with somebody who clearly has a firearm on their person,&quot; says Capt. Doug Moretto.<br />
<br />
In Sunnyvale, officers have been issued clear-cut directives in accordance with state law.<br />
<br />
The weapon can be inspected, but there can be no search for the gun's serial number. The open carrier cannot be within 1,000 feet of a school, on the grounds of a college or university, or in government buildings or secure areas of airports.<br />
<br />
Also, people with drug or violent crime convictions or mental disorders cannot open carry.<br />
<br />
David Julian said he is nervous when he is not carrying his gun and feels everyone should arm themselves.<br />
<br />
&quot;I think you increase the level of politeness. People aren't likely to yell obscenities or be rude if they think you are armed,&quot; said Julian.<br />
<br />
During his interview with KTVU on the subject of open carry, Sunnyvale Public Safety Captain Doug Moretto pointed out a department memorial for fallen officers who were gunned down.<br />
<br />
&quot;We have a difficult time understanding the point of this. What value does this bring to the community right now?&quot; asked Capt. Doug Moretto.<br />
<br />
&quot;If I felt my life was in danger, I'd protect myself,&quot; stated David Julian.

NAIROBI, Kenya – Somali pirates attacked the Maersk Alabama on Wednesday for the second time in seven months, though private guards on board the U.S.-flagged ship repelled the attack with gunfire and a high-decibel noise device.<br />
<br />
A U.S. surveillance plane was monitoring the ship as it continued to its destination on the Kenyan coast, while a pirate said that the captain of a ship hijacked Monday with 28 North Korean crew members on board had died of wounds.<br />
<br />
Pirates hijacked the Maersk Alabama last April and took ship captain Richard Phillips hostage, holding him at gunpoint in a lifeboat for five days. Navy SEAL sharpshooters freed Phillips while killing three pirates in a daring nighttime attack.<br />
<br />
Four suspected pirates in a skiff attacked the ship again on Tuesday around 6:30 a.m. local time, firing on the ship with automatic weapons from about 300 yards (meters) away, a statement from the U.S. Fifth Fleet in Bahrain said.<br />
<br />
An on-board security team repelled the attack by using evasive maneuvers, small-arms fire and a Long Range Acoustic Device, which can beam earsplitting alarm tones, the fleet said.<br />
<br />
Vice Adm. Bill Gortney of the U.S. Naval Forces Central Command, said the Maersk Alabama had followed the maritime industry's &quot;best practices&quot; in having a security team on board.<br />
<br />
&quot;This is a great example of how merchant mariners can take proactive action to prevent being attacked and why we recommend that ships follow industry best practices if they're in high-risk areas,&quot; Gortney said in a statement.<br />
<br />
However, Roger Middleton, a piracy expert at the London-based think tank Chatham House, said the international maritime community was still &quot;solidly against&quot; armed guards aboard vessels at sea, but that American ships have taken a different line than the rest of the international community.<br />
<br />
&quot;Shipping companies are still pretty much overwhelmingly opposed to the idea of armed guards,&quot; Middleton said. &quot;Lots of private security companies employee people who don't have maritime experience. Also, there's the idea that it's the responsibility of states and navies to provide security. I would think it's a step backward if we start privatizing security of the shipping trade.&quot;<br />
<br />
A self-proclaimed pirate told The Associated Press from the Somali pirate town of Haradhere that colleagues out at sea had called around 9 a.m. — 2 1/2 hours after the attack.<br />

&quot;They told us that they got in trouble with an American ship, then we lost them. We have been trying to locate them since,&quot; said a self-described pirate who gave his name as Abdi Nor.<br />
<br />
A U.S. Navy P-3 surveillance aircraft &quot;is monitoring Maersk Alabama and has good voice communication with the vessel,&quot; said Lt. Nathan Christensen, the Bahrain-based spokesman for the 5th Fleet.<br />
<br />
&quot;Everything is safe and secure and Maersk Alabama is proceeding to their intended destination,&quot; Christensen said. The ship was heading for the Kenyan port town of Mombasa.<br />
<br />
Maritime experts said it was unlucky but not unprecedented that the Maersk Alabama had been targeted in a second attack.<br />
<br />
&quot;It's not the first vessel to have been attacked twice, and it's a chance that every single ship takes as it passes through the area,&quot; Cmdr. John Harbour, a spokesman for the EU Naval Force. &quot;At least this time they had a vessel protection detachment on board who were able to repel the attack.&quot;<br />
<br />
Phillips' ordeal last spring galvanized the attention of the U.S. public to the dangers of operating merchant ships in the Horn of Africa, one of the busiest and most precarious sea lanes in the world.<br />
<br />
Underscoring the danger, a self-proclaimed pirate said Wednesday that the captain of a ship hijacked Monday had died of wounds suffered during the ship's hijacking. The pirate, Sa'id, who gave only one name for fear of reprisals, said the captain died Tuesday night from internal bleeding.<br />
<br />
The EU Naval Force has said the Virgin Islands-owned chemical tanker the Theresa was taken Monday with 28 North Korean crew. <br />

Phillips told the AP last month from his farmhouse in Vermont that he was contemplating retiring from sea life after his ordeal. He's been given a book deal and a movie could be in the works. <br />

Phillips was hailed as a hero for helping his crew thwart April's hijacking before he was taken hostage, but he says he never volunteered, as crew members and his family reported at the time. He says he was already a hostage when he struck a deal with the pirates — trading him for their leader, who was taken by the Maersk Alabama's crew.</div>

 They arrest you for First Degree Murder and Illegal Possession of a Firearm. When you talk to your attorney, he tells you not to worry: authorities will probably plea the case down to manslaughter.<br />
<br />
&quot;What kind of sentence will I get?&quot; you ask.<br />
<br />
&quot;Only ten-to-twelve years,&quot; he replies, as if that's nothing. &quot;Behave yourself, and you'll be out in seven.&quot;<br />
<br />
The next day, the shooting is the lead story in the local newspaper.. Somehow, you're portrayed as an eccentric vigilante while the two men you shot are represented as choirboys. Their friends and relatives can't find an unkind word to say about them. Buried deep down in the article, authorities acknowledge that both &quot;victims&quot; have been arrested numerous times. <br />
<br />
But the next day's headline says it all: &quot;Lovable Rogue Son Didn't Deserve to Die.&quot; The thieves have been transformed from career criminals into Robin Hood-type pranksters. As the days wear on, the story takes wings. The national media picks it up, then the international media. The surviving burglar has become a folk hero.<br />
<br />
Your attorney says the thief is preparing to sue you, and he'll probably win. The media publishes reports that your home has been burglarized several times in the past and that you've been critical of local police for their lack of effort in apprehending the suspects. After the last break-in, you told your neighbor that you would be prepared next time. The District Attorney uses this to allege that you were lying in wait for the burglars.<br />
<br />
A few months later, you go to trial. The charges haven't been reduced, as your lawyer had so confidently predicted. When you take the stand, your anger at the injustice of it all works against you. Prosecutors paint a picture of you as a mean, vengeful man. It doesn't take long for the jury to convict you of all charges.<br />
<br />
The judge sentences you to life in prison.<br />
<br />
This case really happened.<br />
<br />
On August 22, 1999, Tony Martin of Emneth, Norfolk , England , killed one burglar and wounded a second. In April, 2000, he was convicted and is now serving a life term.<br />
<br />
How did it become a crime to defend one's own life in the once-great British Empire?<br />
<br />
It started with the Pistols Act of 1903. This seemingly reasonable law forbade selling pistols to minors or felons and established that handgun sales were to be made only to those who had a license. The Firearms Act of 1920 expanded licensing to include not only handguns but all firearms except shotguns.<br />
<br />
Later laws passed in 1953 and 1967 outlawed the carrying of any weapon by private citizens and mandated the registration of all shotguns.<br />
<br />
Momentum for total handgun confiscation began in earnest after the Hungerford mass shooting in 1987... Michael Ryan, a mentally disturbed man with a Kalashnikov rifle, walked down the streets shooting everyone he saw. When the smoke cleared, 17 people were dead.<br />
<br />
The British public, already de-sensitized by eighty years of &quot;gun control&quot;, demanded even tougher restrictions. (The seizure of all privately owned handguns was the objective even though Ryan used a rifle.) [MM: Problem-Reaction-Solution...played to perfection by MI-5!!!]<br />
<br />
Nine years later, at Dunblane , Scotland , Thomas Hamilton used a semi-automatic weapon to murder 16 children and a teacher at a public school.<br />
<br />
For many years, the media had portrayed all gun owners as mentally unstable or worse, criminals. Now the press had a real kook with which to beat up law-abiding gun owners. Day after day, week after week, the media gave up all pretense of objectivity and demanded a total ban on all handguns. The Dunblane Inquiry, a few months later, Sealed the fate of the few sidearms still owned by private citizens.<br />
<br />
During the years in which the British government incrementally took away most gun rights, the notion that a citizen had the right to &quot;armed self-defense&quot; came to be seen as vigilantism. Authorities refused to grant gun licenses to people who were threatened, claiming that self-defense was no longer considered a reason to own a gun. Citizens who shot burglars or robbers or rapists were criminally charged while the real criminals were released.<br />
<br />
Indeed, after the Martin shooting, a police spokesman was quoted as saying, &quot;We cannot have people take the law into their own hands.&quot;<br />
<br />
All of Martin's neighbors had been robbed numerous times, and several elderly people were severely injured in beatings by young thugs who had no fear of the consequences. Martin himself, a collector of antiques, had seen most of his collection trashed or stolen by burglars.<br />
<br />
When the Dunblane Inquiry ended, citizens who owned handguns were given three months to turn them over to local authorities. Being good [brainwashed, ignorant and dumbed-down] British subjects, most people obeyed the law [sic]. The few who didn't were visited by police and threatened with ten-year prison sentences if they didn't comply. Police later bragged that they'd taken nearly 200,000 handguns from private citizens.<br />

How did the authorities know who had handguns? The guns had been registered and licensed. Kinda like cars.<br />

HR-45: Gun Control Conspiracy <br />

(Sep. 17, 2009) There is a HR-45 bill that was introduce to the 111th Congress by Illinois Representative Bobby Rush by the title of &quot;The Blair Holt Firearm Licensing and Record of Sale Act of 2009.&quot; <br />
<br />
The purpose of the bill, according its description in the Thomas legislative information directory of the Library of Congress, is &quot;To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms, and for other purposes.&quot; <br />
<br />
Currently, the bill has been referred to the Subcommittee on Crime, Terrorism, and Homeland Security. <br />
<br />
The bill calls for universal background checks of gun owners, the keeping of records of maintenance and permits, the prevention of child access to firearms, the notification that the gun owner had changed addresses within 60 days and mandatory reporting to the Attorney General of loss or theft of firearms within 72 hours. <br />
<br />
If passed, the bill would require gun owners to fill out an application for a firearm license and provide name, address, birthday, place of birth, any known aliases, a passport sized photograph and a thumb print.<br />

Obama's 'Stimulus' Bill Includes Gun Control Scam <br />

This newly uncovered document is just the latest in a long sordid line of training manuals in which the federal government characterizes millions of American citizens as potentially violent terrorists who are a threat to law enforcement.<br />

The document is entitled Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment (PDF Link) and was released just a few days ago. <br />
<br />
The paper is labeled Law Enforcement Sensitive and states, &quot;No portion of the LES information should be released to the media, the general public, or over non-secure Internet servers. Release of this information could adversely affect or jeopardize investigative activities.<br />

Montana Passes Stunning New Gun Law <br />
<br />
 Montana Gov. Brian Schweitzer has signed into law a bill that aims to exempt Montana-made guns from federal regulation.<br />
<br />
House Bill 246 was sponsored by Republican Rep. Joel Boniek of Livingston. It applies only to guns made and kept in Montana.<br />
<br />
Its supporters hope it triggers a court case to test the legal basis for federal rules governing gun sales.<br />
<br />
The measure is 1 of many introduced this year by state lawmakers across the nation that seek to assert state sovereignty.<br />
<br />
Along with the gun bill, Montana legislators are also considering a resolution that affirms the federal government only has those powers listed in the U.S. Constitution.<br />
<br />
House Resolution 3 follows an effort that failed earlier this session. It was heard Wednesday by the House Judiciary Committee.<br />
<br />

A former soldier who handed a discarded shotgun in to police faces at least five years imprisonment for &quot;doing his duty&quot;.<br />
<br />
Paul Clarke, 27, was found guilty of possessing a firearm at Guildford Crown Court on Tuesday – after finding the gun and handing it personally to police officers on March 20 this year.<br />
<br />
The jury took 20 minutes to make its conviction, and Mr Clarke now faces a minimum of five year's imprisonment for handing in the weapon.<br />
<br />
In a statement read out in court, Mr Clarke said: &quot;I didn't think for one moment I would be arrested.<br />
<br />
&quot;I thought it was my duty to hand it in and get it off the streets.&quot;<br />
<br />
The court heard how Mr Clarke was on the balcony of his home in Nailsworth Crescent, Merstham, when he spotted a black bin liner at the bottom of his garden.<br />
<br />
In his statement, he said: &quot;I took it indoors and inside found a shorn-off shotgun and two cartridges.<br />
<br />
&quot;I didn't know what to do, so the next morning I rang the Chief Superintendent, Adrian Harper, and asked if I could pop in and see him.<br />
<br />
&quot;At the police station, I took the gun out of the bag and placed it on the table so it was pointing towards the wall.&quot;<br />
<br />
Mr Clarke was then arrested immediately for possession of a firearm at Reigate police station, and taken to the cells.<br />
<br />
Defending, Lionel Blackman told the jury Mr Clarke's garden backs onto a public green field, and his garden wall is significantly lower than his neighbours.<br />
<br />
He also showed jurors a leaflet printed by Surrey Police explaining to citizens what they can do at a police station, which included &quot;reporting found firearms&quot;.<br />
<br />
Quizzing officer Garnett, who arrested Mr Clarke, he asked: &quot;Are you aware of any notice issued by Surrey Police, or any publicity given to, telling citizens that if they find a firearm the only thing they should do is not touch it, report it by telephone, and not take it into a police station?&quot;<br />
<br />
To which, Mr Garnett replied: &quot;No, I don't believe so.&quot;<br />
<br />
Prosecuting, Brian Stalk, explained to the jury that possession of a firearm was a &quot;strict liability&quot; charge – therefore Mr Clarke's allegedly honest intent was irrelevant.<br />
<br />
Just by having the gun in his possession he was guilty of the charge, and has no defence in law against it, he added.<br />
<br />
But despite this, Mr Blackman urged members of the jury to consider how they would respond if they found a gun.<br />
<br />
He said: &quot;This is a very small case with a very big principle.<br />
<br />
&quot;You could be walking to a railway station on the way to work and find a firearm in a bin in the park.<br />
<br />
&quot;Is it unreasonable to take it to the police station?&quot;<br />
<br />
Paul Clarke will be sentenced on December 11.<br />
<br />
Judge Christopher Critchlow said: &quot;This is an unusual case, but in law there is no dispute that Mr Clarke has no defence to this charge.<br />

Well, a glimmer of hope for common sense. Also exempts inheritance of gun collections and returns/exchanges of purchases. <br />

Hope it's the beginning of a trend ... but I'm not holding my breath.<br />

A binational task force on U.S.-Mexico border issues will call Friday on the Obama administration and Congress to reinstate an expired ban on assault weapons and for Mexico to overhaul its frontier police and customs agencies to mirror the U.S. Department of Homeland Security. <br />

The recommendations are among a broad set of security, trade, development and environmental proposals that come as President Obama and his Mexicans counterpart, Felipe Calderón, move to deepen engagement on issues including economic recovery, climate change, illegal immigration and narcotics trafficking. <br />
<br />
Robert C. Bonner, the U.S. co-chairman of the private task force, which included several former senior government officials from both countries, said the changes could be included in a follow-up to the Merida initiative, a $1.4 billion three-year commitment of U.S. aid to support Mexico's crackdown on drug cartels that ends next year. <br />
<br />
The proposals &quot;will transform management of the border from a source of contention and frustration into a model of cooperation,&quot; states a report by the Los Angeles-based Pacific Council on International Policy and the Mexican Council on Foreign Relations titled, &quot;Rethinking the U.S.-Mexico Border.&quot; The 30-member task force blamed lack of collaboration for violence, billions of dollars in lost economic opportunities and a public perception of a &quot;broken&quot; system. <br />
<br />
The study comes as Mexico's struggle to combat narco-traffickers and public corruption from the multibillion-dollar North American drug trade has forged a tighter relationship between the neighbors. In reaction, policy analysts and think tanks, most recently the School of the Northern Border in Mexico and the Woodrow Wilson International Center for Scholars, have developed border development proposals. <br />
<br />
Skeptics say U.S. attention to its troubled partner is outpaced by what it spends to combat drugs in places such as Colombia or Afghanistan, while the southbound flow of weapons into Mexico -- where private gun ownership is illegal -- has been a flashpoint as Mexico's death toll from drug-related violence has topped 15,000. <br />
<br />
In Mexico City in April, Obama pledged to push the Senate to ratify an inter-American arms-trafficking treaty but backed away from a campaign promise to reinstate a ban on assault weapons that Congress let expire in 2004.
