Yesterday the National Rifle Association (NRA) filed a lawsuit in the United States District Court for the Northern District of Texas Lubbock Division. James D'Cruz of Lubbock, TX is the plaintiff in this case.

If there ever was a law that failed rational basis scrutiny (essentially a judicial giggle test), this would be it. The NRA lawsuit makes sense, and should be a home run.

It is my pleasure to tell the members and viewers of the PAFOA that our struggle will be made a lot easier.

That scumbag from Chicago is NOT seeking a 7th term!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

How fucking great is that!!!!!!!

I am so happy right now

http://www.nytimes.com/2010/09/08/us...html?th&emc=th

CHICAGO — Mayor Richard M. Daley dropped the bomb at a routine news conference at City Hall on Tuesday. With no prelude or fanfare, Mr. Daley announced that he would not seek re-election when his term expires next year.

.“Simply put, it’s time,” he said. “Time for me. And time for Chicago to move on.” Later, he continued: “I’ve done my best. Now, I’m ready with my family to begin the next phase of our lives.”

The shock waves spread across the city — which years ago nicknamed Mr. Daley, a Democrat, Mayor for Life — and all the way to Washington, where the White House chief of staff, Rahm Emanuel, said earlier this year that he would like the job.

On Tuesday, Mr. Emanuel issued a statement honoring the mayor’s service. He did not say whether he intended to run. (The filing deadline for the Feb. 22 election is Nov. 30.)

For the better part of 56 years — for better and for worse — the Mayors Daley will have run Chicago: first, Richard J. Daley, the current mayor’s father, from 1955 to 1976, when he died in office, then Richard M. Daley, from 1989 to 2011. The day after Christmas, he will become the longest-serving mayor in the history of the city, surpassing his father.

Historians may see that as a theme. The younger Daley, 68, inherited a city riven by racial strife and mired in official corruption. Even if he failed to eliminate those ills, some would say, he turned the city into an economic success story, paying particular attention to beautifying Chicago’s aging core.

The younger Mr. Daley promoted the city’s business, tourism, culinary and art industries in a way that positioned Chicago to compete with American cities better known for such things, like New York and San Francisco.

“If you look at other major industrial cities in the Midwest, Chicago has really reinvented itself” over and over again, said Cindi Canary, director of the Illinois Campaign for Political Reform. “It is a beautiful, world-class city, which is not to say it doesn’t suffer from great inequities and crime, or that the Daley administration hasn’t been touched by corruption. But on balance, we have been a city that has been able to thrive. There has been an urban renaissance here, and Mayor Daley played a very big role in that.”

He also tore down some of what his father built, sometimes literally. For instance, the first Mayor Daley built the high-rise public housing projects that became a model for the rest of the country. The second Mayor Daley began tearing down some of the largest projects — considering them a failed experiment in public housing — and many cities followed his example, too.

Despite both mayors’ administrations being plagued by corruption, both are also credited with preventing Chicago from experiencing the ignominious slide that other Midwestern cities had, like Cleveland, Detroit or St. Louis. Coming out of the midcentury, Chicago was known mostly as hog butcher to the world.

Over the decades, the Daleys (and the fewer than a half-dozen intervening mayors) diversified the city, keeping it growing as comparable Rust Belt cities shrank. The elder Daley built O’Hare International Airport, securing Chicago’s place as a national transportation hub in the modern era, as it had been in the age of railroads. The younger Daley expanded O’Hare, a mission that continues to this day.

“The Daley legacy is political continuity, economic development and revitalization,” said Kent Redfield, a political scientist from the University of Illinois, Springfield. “Having stability and continuity in local government has been a big plus in terms of developments, and there’s been a strong relationship with big business and big labor. It was certainly also a hallmark of the first Daley administration, being able to bring economic interests together.”

Last fall, Mr. Daley suffered what was perhaps his most significant recent defeat not in an election but when Chicago lost its bid to host the 2016 Olympic Summer Games. He emerged globally as the city’s promoter in chief and suffered a blow when Chicago was among the first cities eliminated.

Here in Chicago, the news of Mr. Daley’s imminent departure was greeted with near universal shock. “Oh, my God! We know we knew it would happen someday, but I certainly didn’t wake up thinking it would be today,” Ms. Canary said. “It’s very exciting and a little scary.”

.Professor Redfield added, “It is remarkable when you see people walk away from power.”

Perhaps the very definition of a strong mayor with almost absolute command, Mr. Daley leaves no apparent political heirs. He was widely expected to seek a seventh term without serious opposition. Few have been willing to challenge him. But now that he is stepping down, some political experts expect to see a flood of contenders.

In the recent past, several potentially strong candidates have said they would be interested in running for mayor should Mr. Daley decide not to. “One day I would like to run for mayor of the City of Chicago,” Mr. Emanuel, a former mayoral campaign aide, said during an April interview on “The Charlie Rose Show.”

Thomas J. Dart, the Cook County sheriff, is also a possible candidate.

Representative Jesse L. Jackson Jr., who serves the South Side of Chicago and its suburbs, is known to have his eye on the post-Daley era of city politics, though Mr. Jackson has remained largely quiet since becoming entangled in the corruption trial of former Gov. Rod R. Blagojevich.

Mr. Jackson did issue a statement on Tuesday. He said Mr. Daley was leaving the city in poor fiscal shape. “Regarding potential successors, I expect there will be numerous candidates, but only a few can mount a serious bid for mayor,” Mr. Jackson said, not noting whether he would. Other possible contenders have said they were biding their time.

“I can’t remember the last time we had a truly open seat like this,” said State Representative John Fritchey, a Democrat who said he was considering whether to run. “Right now, not knowing who’s running, it’s difficult to make the determination.”

Mr. Daley said at his news conference that although the news media and others might seek some hidden reason for his decision, there was none. “In the end, this is a personal decision,” he said. “No more, no less.”

Chicagoans in political circles said they believed him.

Mr. Daley’s wife, Maggie, has been suffering from breast cancer since 2002. She is a well-known and respected figure here, having done much to help beautify the city.

“In the end, family trumped politics, and we shouldn’t be surprised, because that’s who he is," said Andy Shaw, executive director of the Better Government Association, a local watchdog group.

"I think he visualized a tough re-election campaign interrupted frequently and unexpectedly by new complications in his wife’s cancer fight, and that’s a scenario he wanted to avoid," he added.

By Michael Hasch
PITTSBURGH TRIBUNE-REVIEW
Friday, September 3, 2010

Shoppers and passers-by scurried for cover Friday afternoon when gunmen opened fire on each other in the parking lot of busy Edgewood Towne Center.

"It's insanity. It could have been tragic," said Edgewood police Chief Robert Payne after learning that no bystanders had been hurt. "This is a holiday weekend. The Towne Center probably had more people than normal, and on any given afternoon it's crowded."

Payne believes the only casualty was a man in a car who got help from a passing paramedic along South Braddock Avenue in Regent Square, about a mile from the shopping center. The man, who was shot in the arm or leg, was taken to a hospital where he was being questioned by Allegheny County police, the chief said.

"We believe he was involved," Payne said. "The driver of the car stopped a Murrysville ambulance and said, 'My buddy's been shot.' "

As paramedics aided the wounded man, the motorist drove away.

"We believe three people were involved," he said. "There were two people in the car and a man on foot. We believe the man on foot and the passenger in the car began shooting at each other."

A number of people called 911 shortly after 3 p.m. to report multiple gunshots, Payne said. When officers from Edgewood, Swissvale and Wilkinsburg arrived a minute later, they found witnesses crouching behind vehicles but no sign of the gunmen.

Within minutes, an ambulance was flagged down and there was a report of a fight at the Kmart store in the shopping center.

"A security guard at Kmart stopped a man who fled, dropping a bag that contained a handgun and marijuana into a trash can," Payne said. "We believe he was the gunman who had been on foot."

A second gun was found in a grassy area near the back of the shopping center, the chief said.

"I was sitting in my car when I heard gunfire -- boom, boom, boom, boom. Then I heard the window shatter," said Tracy Morgan, a shopper from Waynesburg.

One stray bullet shattered a window in the Super Nails store, and others hit a passenger door and broke a window in the car of Andrea Hedrick, 20, of Brentwood, who was at work in the GNC store.

"It's my third day on the job here, and this happens," Hedrick said. "One of the cops joked with me, saying, 'It's always quiet here, so we knew there had to be a jinx. It has to be you.' "

Man hurt, 4 held in violent dispute

Shots fired during chase in Poconos

Four people were arrested in Monroe County after a dispute between two men escalated into a road-rage incident that led to gunshots and left one person seriously injured, police said.

Officers found Sean Ivey, 26, of Tobyhanna, lying naked on the ground when they arrived Wednesday around 7 p.m. at Winding Way and Starlight Terrace in Tobyhanna, Pocono Mountain Regional police said. He had suffered what police described as multiple traumatic wounds.

Police arrested Anthony Molyneaux, 28; Brady Lightfoot, 21, and Dennison Herbert, 21, on aggravated assault and related charges, and Michelle Winfrey, 20, for hindering apprehension, police said. Mr. Lightfoot is from New York City; the other three suspects live in Tobyhanna.

According to police:

Mr. Molyneaux and Mr. Herbert, who were involved in an ongoing dispute, came across each other while driving through a Pocono Country Place development and words were exchanged. Mr. Molyneaux, who was driving a Ford Explorer with Mr. Lightfoot as a passenger, started pursuing Mr. Herbert, who along with Ms. Winfrey was riding in a Saturn Ion driven by Mr. Ivey.

During the chase, Mr. Herbert leaned out the window of the Saturn and fired several rounds from an assault pistol at the Ford. The Saturn crashed while rounding a bend, and the Ford slammed into the rear of the vehicle.

Mr. Herbert and Ms. Winfrey ran. Mr. Ivey, who was injured in the crash, was caught by Mr. Molyneaux and Mr. Lightfoot, who stripped him of his clothing and assaulted him. Witnesses told police Mr. Molyneaux was armed with a knife during the assault.

Police said the pistol allegedly wielded by Mr. Herbert was reported stolen in Steubenville, Ohio.
On Monday, when police knocked on her door, Sutton hoped that they were bringing the news she's waited two years to hear.

"I thought they were coming to my door to tell me they had my son's murderer," she said. "But they were coming to take me and my gun, and now I'm defenseless."

Sutton, 38, of North Philadelphia, said that her troubles began last week, when workers from Wilco Cable came to her back door to ask for permission to work in her yard.

She's never had cable, but told them that they could work through her back yard to connect her neighbors' cable. Sutton said that she also asked the workers to never use the back door again.

On Monday, Sutton said, she was awakened by incessant pounding on her back door about 8 a.m. She looked out of the window and saw two men and a woman at her back door, peering in her window.

Scared, Sutton said she grabbed her gun and held it at her side as she answered the door.

She said that she never left her house and never raised the gun. Although they had no identification tags, Sutton said that the three identified themselves as Wilco workers and again asked permission to work on her property. She granted it, but asked why they continued to knock on her back door, despite her previous requests to use the front door.

Sutton said that the workers went about their business but three hours later, about 11:25 a.m., police came to her door. She said she let them in and they went through her house - with guns drawn - even pointing them at her 14- and 16-year-old children.

She said that she was taken into custody, held for 12 hours - from 2 p.m. to 2 a.m. - and that her gun and her license to carry it were taken away from her.

According to court records, Sutton, who has no record, was charged with simple assault and possessing instruments of a crime, both misdemeanors.

Lt. Frank Vanore, police spokesman, said that according to the police report, the cable workers alleged that Sutton was pointing a gun at them when she opened the back door.

What neither side seems to dispute is that Sutton never left her house. Even though a citizen is not required to have a license to carry a firearm in his or her own house, Sutton did, and had both the license and her gun taken away as a result of the incident.

Police said an alleged thief tried to stab another man with a hypodermic needle at a grocery store in Lancaster Township Monday evening.

Miguel Flores, 51, no known address, was observed leaving the Giant store, 1369 Columbia Ave., without paying for $116 worth of razors, according to Manheim Township police.

An employee confronted Flores and a struggle ensued during which Flores allegedly attempted several times to stab the employee with a hypodermic needle, police said.

"At that point, I think the employee realized it was best just to get out of the way," Sgt. Tom Rudzinski said.

Flores then "made a break" for the door but was confronted by police, who had just arrived, Rudzinski said.

Rudzinski said he does not know why Flores had a hypodermic needle but said there was no health concern because the needle didn't penetrate the employee's skin.

Flores was arraigned and committed to Lancaster County Prison in lieu of $10,000 bail.
Obama Administration Reverses Course, Forbids Sale of 850,000 Antique Rifles

By Maxim Lott
Published September 01, 2010
A photo of M1 Garands (National Park Service)

The South Korean government, in an effort to raise money for its military, wants to sell nearly a million antique M1 rifles that were used by U.S. soldiers in the Korean War to gun collectors in America.

The Obama administration approved the sale of the American-made rifles last year. But it reversed course and banned the sale in March – a decision that went largely unnoticed at the time but that is now sparking opposition from gun rights advocates.

A State Department spokesman said the administration's decision was based on concerns that the guns could fall into the wrong hands.

"The transfer of such a large number of weapons -- 87,310 M1 Garands and 770,160 M1 Carbines -- could potentially be exploited by individuals seeking firearms for illicit purposes," the spokesman told FoxNews.com.

"We are working closely with our Korean allies and the U.S. Army in exploring alternative options to dispose of these firearms."

Gun control advocates praised the Obama administration for taking security seriously.

"Guns that can take high-capacity magazines are a threat to public safety," said Dennis Henigan of the Brady Campaign to Prevent Gun Violence. "Even though they are old, these guns could deliver a great amount of firepower. So I think the Obama administration's concerns are well-taken."

But gun rights advocates point out that possessing M1 rifles is legal in the United States -- M1s are semi-automatics, not machine guns, meaning the trigger has to be pulled every time a shot is fired -- and anyone who would buy a gun from South Korea would have to go through the standard background check.

"Any guns that retail in the United States, of course, including these, can only be sold to someone who passes the National Instant Check System," said David Kopel, research director at the conservative Independence Institute. "There is no greater risk from these particular guns than there is from any other guns sold in the United States."

M1 rifles can hold high-capacity ammunition clips that allow dozens of rounds to be fired before re-loading, but Chris Cox, chief lobbyist for the National Rifle Association, noted that is true about any gun in which an ammunition magazine can be inserted -- including most semi-automatics.

"Anything that accepts an external magazine could accept a larger capacity magazine," Cox said.

"But the average number of rounds fired in the commission of a crime is somewhere between 1 and 2 … this issue just shows how little the administration understands about guns."

He called the administration's decision "a de facto gun ban, courtesy of Hillary Clinton's State Department."

Asked why the M1s pose a threat, the State Department spokesman referred questions to the Bureau of Alcohol, Tobacco, Firearms and Explosives. ATF representatives said they would look into the question Monday afternoon, but on Wednesday they referred questions to the Justice Department. DOJ spokesman Dean Boyd referred questions back to the State Department.

According to the ATF Guidebook on Firearms Importation, it would normally be legal to import the M1s because they are more than 50 years old, meaning they qualify as "curios or relics." But because the guns were given to South Korea by the U.S. government, they fall under a special category that requires permission from the State Department before any sale.

Kopel said that he hopes the State Department spokesman's statement that it is working to "dispose" of the guns does not mean they want to melt them down.

"It seems to have this implication of destruction, which would be tremendously wasteful," he said. "These are guns that should be in the hands of American citizens for marksmanship and safety training."

Asked whether melting the guns down would be a good option, Henigan said: "Why let them into the country in the first place? If there is a legally sufficient way to keep them out, we think it's perfectly reasonable to do so."

Past administrations have also grappled with the issue of large-scale gun imports.

The Clinton administration blocked sales of M1s and other antiquated military weapons from the Philippines, Turkey and Pakistan. It also ended the practice of reselling used guns owned by federal agencies, ordering that they be melted down instead.

In contrast, 200,000 M1 rifles from South Korea were allowed to be sold in the U.S. under the Reagan administration in 1987.

A decision like that would be better for everyone, Cox said.

"M1s are used for target practice. For history buffs, they're highly collectible. We're going to continue to make sure that this backdoor effort that infringes not only on lawful commerce but on the Second Amendment is rectified."

Henigan disagrees.

"They clearly were used as military guns, and the fact that they likely can take high-capacity magazines makes them a special safety concern," he said.

The White House referred questions on the issue to the Pentagon, which referred questions to the U.S. Embassy in South Korea, which deferred back to the State Department.

So instead of letting South Korea resell these we are going to melt them down... fucking retards

In the last two years, Philadelphia police have confiscated guns from at least nine men - including four security guards - who were carrying them legally, and only one of the guns has been returned, according to interviews with the men.

Eight of the men said that they were detained by police - two for 18 hours each. Two were hospitalized for diabetic issues while in custody, one of whom was handcuffed to a bed. Charges were filed against three of the men, only to be withdrawn by the District Attorney's Office.

The civil-rights unit of the City Solicitor's Office confirmed that it is handling eight such cases. Two of the men interviewed by the Daily News said that they rejected settlement offers from the city ranging from $3,500 to $7,500. One accepted a $5,000 offer.

Most of the cases hinge on what local authorities call the "Florida loophole," under which a Pennsylvania resident can obtain a nonresident permit to carry a concealed weapon through the mail from another state, even without a permit in Pennsylvania.

The "loophole" is unpopular with Philadelphia cops, who say that it allows those denied a permit here or whose permits were revoked to circumvent Philadelphia authorities and obtain it elsewhere.

But proponents say that it's necessary because Philadelphia has unusually strict criteria for obtaining a concealed-carry permit. Philadelphia, according to police and gun owners, relies heavily on a clause that allows denial of a permit based on "character and reputation" alone.
Around 1am Saturday morning a young 17 yr old punk named Reneau Jean Jacques from East Stroudsburg, PA thought he saw a perfect target to rob at gunpoint in the middle of the night. Joshua Eastman, 28, and also from East Stroudsburg, was busy loading groceries into his car in the parking lot of the local WalMart store. As Jacques ran up to Eastman armed with a handgun, he did not know that Eastman had a concealed handgun license, and was also armed. <--- The CHL bit bugged me, at least the officer knew what to call it in the video.

Jacques threatened Eastman, pointed his handgun at him, and demanded money. Eastman refused to cooperate, and explained that he had no cash on him, and only had a debit card. Eastman then threw his wallet down to the ground, and at the same time ducked behind his car door. At that moment, a bullet from Jacques' pistol smashed through the car door's window, barely missing Eastman.

Now shielded behind his car door, Eastman drew his pistol, and fired back at Jacques from under the door, hitting his attacker multiple times in the leg and foot. Wounded, Jacques then limped away and fled.

Eastman quickly ran back to the store, and the police were summoned. Injured, Jacques was unable to get very far. Police caught Jacques in the act of attempting to bury his pistol under some bushes near the parking lot.

Sgt. James Wielgus of the East Stroudsburg Police Department told the press: "This appears to be an armed robbery that went very badly for the suspect, because he picked on an armed customer." Jacques has been charged as an adult with the crimes of attempted murder, robbery, aggravated assault, violent crime committed with a firearm, and illegal possession of a firearm, all felonies. The teenager now faces up to 30 years in state prison, if convicted of all charges.

Here is a photo taken of Reneau Jean Jacques as police led him out of the hospital, after he had been treated for his gunshot wounds. He is expected to make a full recovery from his wounds.

I bet this punk wont do that again... he is facing 30 years for multiple charges.
