It is what it is, a pen gun. Carrying it with a sign that says, "Hey, this is my pen gun.", may qualify it as being Open Carried, but otherwise if there is some sort of reason you get all your possessions turned out onto the hood of a cop car, and they recognize it, and you don't have a LTCF, I bet you get charged under "6106: Firearms not to be carried without a License, and if you don't have a tax stamp also under "908: Prohibited offensive weapons". That would be my understanding, if it happens, let us know for the files

Its not a firearm in regards to the ATF however it is considered a firearm under the uniform firearms act definition in 6102. No where does it exclude any class 3 or aow weapons. The same item can fall into different categories with different agencies. The UFA does not use a dictionary definition of firearm, it states what is considered a firearm for the chapter in reference. The ATF has a totally different definition depending on the situation. You cant just say well according to the ATF my item is or is not a firearm.

Does that mean it's illegal to make your own? No, I'm not making my own. LOL. I'm just asking because I googled "pen gun" in the interest of seeing what kind of different variations of them there were (never took an interest in them before and just wanted to look) and there are several results for making your own. I had read your post before I googled so as I was skimming the results I was thinking, that can't be legal...can it?

You can make your own but if it is a AOW you will have to file a Form 1 with ATF and wait until it is approved before you start making it.

Oh I see. Well I'm not going to make one anyway. There are just an awful lot of results when you google "pen gun". LOL. I was just looking to see different "models" or whatever.

How often does one shoot a pen gun at the range anyway?

this is all i could find, other than that i would think that in its pen form, as someone else stated, its technically "concealed" as a pen. personally i'd rather have this one:

I'm not to sure and would hate to tell you something and it be wrong and you get in trouble, but I'll tell you one thing, that's pretty cool and never seen one until now. where can you buy one of them things? or you can't? what caliber is that?
