I think you handled it just fine. In fact, that was the same way you should have handled it even if it was a real cop.

I believe simple assault is unwanted touching, aggravated assault is bodily injury, but again, I could be wrong.

I agree with both of you - 2701 (3) would probably have to be stretched to make simple assault work, but battery fits just fine. thanks to both of you for the insight.

I would have to concur with Steve In PA. You were polite and stood
your ground in a very courteous manner. I would make a call to the
Mall and Identify the Licensed Security Agency who is contracted by
the Mall, Shopping center, etc.. Advising the "Security Company" of the
incident and its agent misrepresenting himself, and pointing out the
lack of his knowledge, and then advising them of your intention of notifying
the P.D. of that jurisdiction of his misrepresentation . That should stir the
pot, making them aware of criminal as well as civil liabilty.

I agree with the others, that guard committed at least one crime and possibly several. If it were me I would follow up and have him charged. He had NO RIGHT touching you. If a person can be charged with assault because they "spit" on a police officer that guard can be charged with assault for touching you.

It's my non-legal opinion you probably have a law suit against someone because you were detained against your wishes, touch by someone you didn't want touching you and all of this was done in front of your child!

You did very well under the stress of someone confronting you when you had your child with you.

Please keep us informed if something comes of this...

Simple assault = bodily injury

Agg assault = serious bodily injury

Harassment = physical contact (less than bodily or serious bodily injury)

I think you did an excellent job. I would be ALL OVER that business of finding out if he was really a cop or just impersonating one. That IS a crime and any REAL cop should be highly insulted by that.
