It may be hard to get the DA to prosecute this mall ninja for Impersonating, but it would be fairly easy to contact his employer and have him fired, or at least censured. An employer doesn't want the liability of one of its agents wandering around committing M-2's in its name, especially armed agents.

Well, I know that he was working today, October 5th around 12:30. He carries a revolver on his LEFT side, so he shouldn't be hard to identify by employers.

Make sure you tell them which store you saw him at. He is privately employed by that store and the property owners / Outlet management will verify that. Hopefully they know which store he is employed at.

Wouldn't the touching be considered a simple assault?

persue this further. It doesn't sound like this guy has any legal authority to detain you, let alone make you feel like you did anything wrong.

Handled it quite well, IMHO.

Simple assault dealing with "bodily injury"....touching is not bodily injury.

Harassment would be unwanted contact.

That right there is a big red flag. Of course, this same tactic can also be employed by authentically credentialed individuals who know they've done wrong and don't want to get jammed up - ala Constable Spielman in Franklin County, Pa.

When I was much younger the mall I used to hang out at had an off duty cop working as security, but he wore his police uniform, not a security guard outfit. Don't know if they still do that but there was no mistake the guy was a cop. However, the mall was in two jurisdictions 2/3rds of it in his township, if he had trouble in the other part he would call the local police for that part to take care of any arrests he made.

When I was in construction doing highway repairs we hired off duty Philadelphia cops to work the work zone, they had a police car and uniform when performing this job but were technically off duty.

This experience led me to believe an off duty cop moonlighting as a security guard would have his dept. uniform on.

no, but it can be considered battery; any unwanted contact can be considered battery, if it causes injury, it's assault. so, the wannabe committed: battery, harassment, and impersonating a LEO. he hit the trifecta!
