Default How to legally show my new firearm to father in NJ?

In a quandary here. I want to show my father my new firearm, but he lives in Brigantine NJ.

I have read the NJ law, and they seem to allow carry of firearms by un-permitted owner unloaded in-trunk, to go to a vacation home, or to go to a range of which you are a member. It's not clear to me whether this law allows non-residents to do this. Does anyone here know?

Technically yes, but God help you if you're pulled over and they search/otherwise find a firearm with you.


My suggestion would be to invite him over to your place.

what country is NJ in, again? is there really a place in the country you cannot take an unloaded, cased, locked, legal firearm?

I believe it's Ocean County. The way I read the law, (and I am asking for guidance here,) is that in order to carry an unarmed handgun your trunk:

1. You have a license to carry. I understand in New Jersey virtually no one is issued one.

2. You are going to or from a range of which you are a member, and that range is licensed by the state, and a ist of its members has been given to the state,

3. You are going from your place of abode to a vacation home.

Now my question is:

1. Does this also apply to out-of-state residents?
2. Is my father's home on the Jersey shore considered a vacation home for *me*?

If you're certain that it's legal to stand on the ground at your destination while holding an unconcealed handgun, then the 1986 FOPA should protect you if you travel with it unloaded in a secure container, preferably in your trunk. If you have a pickup truck, you have to buy a separate lock box if you want to keep it in the cab. "Unloaded" in PA means that the magazine is separate from the gun, if there are rounds in the mag; I don't know what the Feds or NJ consider to be "unloaded".

By the way, NY and NJ cops and prosecutors are famous for ignoring the Federal pre-emption of local gun laws.

Have your father travel to PA, it's safer.

Tell your father what kind of gun it is and have him go look at it at a gun shop near him...unless it's something so unique that the shop wouldn't have!

Have your dad come to PA, feed him a nice meal, and take him to the range. If you get stopped in NJ with out of state plates with a gun you will be detained for a big chunk of time at the very least. At the most you will end up paying $$$$ to fight the charges, and maybe loose.

Another reason not to talk to the police. "I do not grant permission to search my person or property. If I am not being detained, I would like to leave. Now." That should about cover it.

A locked gun case, gun rug, or brief case locked in the trunk of your car. How many warrants would he need to do a legal search? If you don't draw attention to yourself, no problems. Just my $.02.
