    I lost track. What occurred with the Erie case and what is the likely result/effect to Falls' proposed ordinance?

    Erie was reversed in Commonwealth court in favor of defendent and affirming pre-emption. Falls Twp stated they were waiting for outcome of Erie case to decide on their own regulation of firearms.

Bring into or upon County real estate , nor have in his or her possession, nor discharge, or set off anywhere upon said properties, a revolver, pistol, shotgun, rifle, air rifle, air gun, water gun, or any gun, rifle, firearm, or bow or other weapon that discharges projectiles either by air, e xplosive substance or by any other force...
    Wait a minute! Water gun. They going to lock up the kids shooting Super Soakers at each other?

    Falls Twp Update:

    I attended township meeting last night and have some good news for you.

    During the closing board comments a supervisor asked Mr Clarke (solicitor) what was needed to kill the proposed Ord # 199 (ban of firearms in twp bldg's).

    Mr. Clarke replied the ordinance was tabled indefinately. The supervisor says, "good because it didnt make any sense anyway and needs to be gone forever". Another supervisor asked, "what was needed to amend the ord#168-15 (firearm ban in parks) and would the twp still have legal issues?

    The good liberal Mr. Clarke's response was, "we (meaning him) believe the oridnance is enforcable". Another supervisor says, "it doesnt make sense -how old is the ordinance anyway? It's merely a reference to no hunting or trapping in the parks - it does not make sense. Mr. Clarke how do we amend the ordinance removing the word firearm"?
    Again, Mr. Clarke replied, "you need to tell us to do so and we will draft an amended ordinance, sent to the board for review, then advertise it and then it can be voted at the next meeting".

    The supervisor's reply was, "ok, then Mr. Clarke. I am directing you & your staff to draft an amended ordinance for next month."

    Mr Clarke was obviously not happy, but will comply if he likes his job. Too bad so sad.

    Not sure what made them change their anti-gun menatlity to compliance of state law. I made it a point to personally talk to 3 of the supervisors and communicate via email since the Nov meeting. I guess I finally got them to understand.

    So hopefully we are on the right track in getting Falls to be 2A friendly and the ordinances changed for the good.

    I want to thank everybody who showed up at the Nov meeting and spoke!

    The next 2 meetings are Feb. 18th and March 4th.

    I will be going to both and all are welcome too.

    Thanks for your work on this situation!

    I think I would not drink the water in Falls Township...something weird going on there. An apartments there recently issued notices to their residents of draconian no smoking rules. Cannot smoke anywhere, including within your own vehicle while on their parking lots.

    Thank you for staying on this and please let us know when the new draft of the ordinance is complete. If there is no language barring firearms that would be the second removal of such bans since Erie (I am keeping track).
