Default Small OC encounter with PSP

Two summers ago I had called the PSP because of a problem I was having with a repeat trespasser. When I came back to the house on my ATV the trooper was in my driveway. I drove right up to the car to talk with him and the first thing this guy started with was my .357 in my shoulder holster. He had asked me to take it off and while he was there I saw no reason to have it on. When I went to take it off and he puts his hand on his sidearm and tells me to stop. I immediately say "TAKE IT EASY". He then tells me to take off the whole thing, holster and gun. After taking it off we had a calm discussion about the trespasser. Although the whole time I could see a look of smug about him.

I don't think that I will take it off if it happens again. I was still new to carrying in general so I didn't want to do anything illegal. I am much more educated and more sure of myself now.

You should have tried to speak to his supervisor. OC as we know is legal. I take it you were on your own property....so OC on vehicle or CC would be ok even without LTCF. The trooper was way out of line.

Any cop who has a problem with peaceable, law abiding people carrying, openly or concealed, should look for another line of work.

just FYI, it is actually illegal to carry a loaded firearm on an ATV in PA.

a seriously stupid law, but a law nonetheless.

Quote:
§ 7727. Additional limitations on operation

Except as otherwise permitted under Title 34 (relating to game), no person shall:

(1) Operate or ride in any snowmobile or ATV with any bow and arrows or with any firearm in his possession unless it is unstrung or unloaded.

(2) Drive or pursue any game or wildlife with a snowmobile or an ATV.

Does that law apply when on your own property? With a LTCF?
If so I'm screwed, I riden my kid's 50cc quad around the yard many times.

I can't imagine that they can apply that to you on your own property........

yes. it does still apply.

although, given that it is a "game" law, it would seem the intended purpose is to prevent people from hunting from ATVs.

so, imho, an LEO would have to be a real a-hole to bust you if you were on your own property and not hunting. but, he still legally could.

That statute has: (relating to game) in parenthesis...so does that only apply when using the ATV for hunting related purposes?

I carry on my atv all the time. I use it to "patrol" my property to keep the rif-raf out.

Private Property is just that!

Send me to jail ? for carrying on my property,on an atv ,in a vehicle,on foot it doesn't matter.
