I think he might be ref. an "Emergency Commitment". That can actually be done IF a magistrate is not available. If I recall correctly....without looking in a hand full of counties.

The warrant never would've been issued -- they must state, under oath or affirmation, that they reasonably believe that the weapon that actually committed the crime was in your house. You can refuse to let them see it, but if they really thought it was the actual murder weapon, they would've already had their warrant.
They probably would've moved on as no judge would sign that warrant... if they did, and it came to be that your weapon wasn't used, you'd have supreme grounds for a lawsuit. |

As a side question, does anyone think there is even the slightest chance that what the OP posted actually happened?
A cop shooting so a squad of a half dozen BATFE agents go warrentless door to door asking to see guns purportedly of similar caliber to one involved in the shooting. In a criminal investigation no less (makes the warrentless part so unlikely as to be impossible). Of course all federal agents know that a straw buyer would invite federal agents into their homes without warrants when the news is filled with 24/7 reports about a citywide manhunt so that's why they would routinely go door to door asking to see guns. Then, when the straw buyer slips up and admits he/she can't produce the gun 'cause it must have just been "stolen," BATFE can help take the stolen gun report while the killer remains on the loose. Yeah, federal agents would waste their time with that. The whole premise is downright stupid to begin with.Would someone just please delete the whole thread? |
